Reviewing the submitted documents and contents of the draft Decree on sea encroachment activities

Regarding the method of determining land prices, the Deputy Prime Minister agreed with the opinions of the Ministry of Finance and experts. The determination of land prices has been fully regulated in Decree No. 12/2024/ND-CP dated February 5, 2024 of the Government. Therefore, the request for reference applies the provisions of Decree No. 12/2024/ND-CP.

The Minister of Finance commented that the transitional provision (Article 11) is new and has not been assessed by the Ministry of Justice. Regarding this, the Deputy Prime Minister requested the Ministry of Natural Resources and Environment to preside over and coordinate with the Ministry of Justice to carefully review the entire content of Article 11 and agree on a handling plan to ensure strictness and compliance with legal regulations.

Regarding Clause 3, Article 4, the Deputy Prime Minister agreed with the opinion of the leaders of the Hai Phong City People's Committee attending the meeting. The Ministry of Natural Resources and Environment proactively coordinated with the Hai Phong City People's Committee to complete regulations on updating land use planning, related land use plans, and land use targets for completed sea encroachment projects, ensuring a legal basis, strictness, and feasibility.

Regarding Article 6 regulating the authority to allocate land, lease land, and allocate sea areas, the Deputy Prime Minister agreed with the opinions of the delegates that the allocation of sea areas is very sensitive, so it should not be delegated to the district. He agreed with the content of the regulations on this issue in the draft based on the scale and level of the project.

Regarding Clause 3, Article 7 regulating the dry tide line, the Deputy Prime Minister agreed with the opinion of the leader of the People's Committee of Quang Ninh province in the direction that the provincial natural resources and environment agency determines the dry tide line and reports to the Provincial People's Committee to send to the Ministry of Natural Resources and Environment according to regulations.

The issue of investment policy needs to be separated according to the provisions of the law on investment, public investment, and bidding law; 01 article needs to be added for clarity.

The Ministry of Natural Resources and Environment coordinates with the Ministry of Construction to review and ensure consistency with construction law regulations.

Regarding the budget estimate for sea encroachment, the Deputy Prime Minister agreed to add other costs and costs related to loan interest.

The Deputy Prime Minister assigned the Minister of Natural Resources and Environment to direct the full implementation of the above conclusions, carefully study the opinions of the Government members, the Appraisal Report of the Ministry of Justice, the opinions expressed at the meeting, review the submitted documents, the content of the draft Decree to complete the documents, the draft Decree to ensure compliance with the provisions of relevant laws, the Government's Working Regulations, closely follow the provisions of Article 190 of the 2024 Land Law, ensuring the draft Decree is highly feasible.
