Quang Binh considers handling investor's petition

Receiving the request from the investor of the Shophouse commercial townhouse project to review the amount of land use and land rent incurred, the Chairman of the People's Committee of Quang Binh province directed the competent authorities to review and ensure compliance with regulations.

The Shophouse Complex project combining commercial services and resort hotels in Dong Hai ward, Dong Hoi city (Quang Binh) has a total investment of 901 billion VND. The project was approved by the People's Committee of Quang Binh province in March 2019, with a scale including the construction of a 5-star high-rise hotel block with a floor area of ​​about 37,000m2; construction of a residential block combined with business (shophouses with a maximum height of no more than 22m) with an area of ​​about 18,700m2 and other essential technical infrastructure works.

It is known that at the end of 2021, the total value of residential and commercial land of the project was more than 124 billion VND. The investor said that it had fulfilled its obligations to the State budget.

However, 4 years later, according to Decision No. 496/QD-UBND of the People's Committee of Quang Binh province dated February 27, 2025, the approval of specific land prices to calculate land use fees and land rents that investors must pay to the State budget was adjusted, accordingly, the amount to be paid increased by more than 16 billion VND. In particular, the determined value of the land for building commercial townhouses combined with business services (urban residential land) is 112.233 billion VND, an increase of nearly 12.84 billion VND; and the determined value of the land for building a commercial service complex of hotels and resorts (commercial service land) is 28.771 billion VND, an increase of 4.13 billion VND.

The reason for the adjustment is stated to be due to re-determining the technical infrastructure costs according to the results provided by the Department of Construction in Official Dispatch No. 1466/SXD-ĐTHT&KTXD dated June 14, 2024 of the Department of Construction on reporting the results of reviewing the technical infrastructure costs of the project.

Regarding this issue, at the first quarter 2025 meeting with businesses and investors organized by the People's Committee of Quang Binh province, Director of Hai Thanh Construction and Trading Company Limited Hoang Van Minh said that the reason for the adjustment is due to the re-determination of technical infrastructure costs, which is not appropriate, and the calculation method will cause businesses to pay technical infrastructure costs twice. In addition, business representatives also hope to have the opportunity to fulfill their obligations to the State budget and discuss with the authorities before making a decision that affects the unit's cooperation opportunities with foreign partners.

“Recently, the company was quite surprised to receive a notice from the tax authority that it had to pay an additional 16 billion VND in land use and land rent fees. In 2021, the company fully paid the land use fees for 59 plots of land and was accepted by the departments and agencies and granted land use right certificates,” said Hoang Van Minh, Director of Hai Thanh Construction and Trading Company Limited.

Taking note of the enterprise's content, Deputy Secretary of the Provincial Party Committee and Chairman of the Provincial People's Committee Tran Phong discussed and assigned the relevant agencies to review the enterprise's petition content to have a thorough response.

“The Provincial People's Committee has received feedback from Hai Thanh Construction and Trading Company Limited. The Provincial People's Committee requests the Department of Construction and related departments to promptly handle the enterprise's petition,” emphasized Chairman of the Quang Binh Provincial People's Committee Tran Phong.
