Many decisions according to practical requirements in the Electricity Law Implementation Plan

On December 11, 2024, the Prime Minister signed Decision No. 1544/QD-TTg promulgating the Plan to implement the Electricity Law approved by the 15th National Assembly at the 8th Session, effective from February 1, 2025.

Implementing the Electricity Law has a specific roadmap from February 1, 2025

The plan aims to propagate and disseminate the Electricity Law to the people, cadres, civil servants, public employees and workers; train and foster professional skills for cadres, civil servants, public employees and workers working in the electricity sector; raise awareness and sense of responsibility of people in using electricity after the meter, on electrical safety, ensuring electricity works and complying with the Electricity Law.

The Plan specifically defines the work contents, deadlines, completion progress and responsibilities of relevant agencies and organizations in organizing the implementation of the Electricity Law, ensuring timeliness, consistency and effectiveness; Determine the coordination mechanism between ministries, ministerial-level agencies, government agencies and localities in carrying out activities to implement the Electricity Law nationwide.

In addition, the Plan also requires ensuring the regular leadership and direction of the Government and the Prime Minister in the process of organizing the implementation of the Electricity Law; determining the content of work must be complete and specific; assigning implementation responsibilities in accordance with the functions, tasks and powers of agencies and organizations; promoting the responsibility, proactiveness and positivity of ministries, ministerial-level agencies, People's Committees at all levels, ensuring regular and effective coordination between ministries, ministerial-level agencies, People's Committees at all levels and other relevant agencies and organizations in implementing the Electricity Law.

The implementation of the Electricity Law has a specific roadmap to ensure that from February 1, 2025, the Electricity Law is implemented synchronously, uniformly, and fully, along with detailed regulations for implementation nationwide; regularly inspect, urge, guide, and promptly resolve problems and difficulties arising during the implementation process to ensure the progress and effectiveness of the implementation of the Electricity Law.

Drafting detailed legal documents

The plan approved by the Prime Minister sets out two main contents in implementing the Electricity Law.

Regarding the work of perfecting institutions, policies and legal documents , the Prime Minister assigned the Ministry of Industry and Trade and relevant ministries and branches to develop legal documents detailing the Electricity Law according to the Prime Minister's Decision on assigning the agency in charge of drafting documents detailing the implementation of laws and resolutions passed by the 15th National Assembly at the 8th Session.

Legal documents are developed according to the simplified procedures and order, which must ensure the following principles: Ensuring the collection of opinions from subjects directly affected by the document; Adhering closely to the spirit and guiding viewpoints of the National Assembly, the National Assembly Standing Committee, the Government, and the Prime Minister in the process of developing and promulgating the Electricity Law; Ensuring maximum inheritance of current regulations that are "ripe", "clear", and have been implemented stably and effectively in the recent past; ensuring the maintenance and development of breakthrough policies and regulations recently issued by the Government in the direction of updating the legal basis and new regulations of the Electricity Law.

The Ministry of Industry and Trade shall preside over and coordinate with relevant ministries and branches to develop a List of other documents to implement the Electricity Law attached to this Plan. Based on this Plan and on the basis of integrating the list of documents detailing the Electricity Law, the Ministry of Industry and Trade shall develop and issue a specific Plan to implement the Law, including: List of documents to implement the Electricity Law, other necessary contents to organize the timely, practical and effective implementation of the Law.

The Ministry of Justice shall preside over and coordinate with the Ministry of Industry and Trade and relevant ministries and branches to promptly appraise legal documents detailing the Electricity Law.

Regarding the organization of reviewing legal documents , the Prime Minister assigned the Ministry of Industry and Trade to preside over and coordinate with ministries and branches to systematize and make a list of legal documents related to the electricity sector; review to promulgate according to authority or submit to competent State agencies for amendment, supplementation, replacement, repeal or new issuance, ensuring compliance with the provisions of the Electricity Law.

Ministries and branches, based on their assigned functions and tasks, are responsible for organizing the review of legal documents related to electricity in their fields of responsibility, promulgating them according to their authority or submitting them to competent State agencies for amendment, supplementation, replacement, repeal or new issuance, ensuring compliance with the provisions of the Electricity Law.

Ministries, branches, and People's Committees at all levels shall proactively implement the contents assigned at Points a and b of this section, and send the List of documents that need to be amended, supplemented, replaced, or abolished to the Ministry of Industry and Trade before March 1, 2025 for synthesis, monitoring, urging, and coordination of implementation according to regulations.

Regarding implementation, the Plan states that the Minister of Industry and Trade is responsible for assisting the Prime Minister in monitoring, inspecting, and urging ministries to implement the tasks stated in the Plan.

Ministers, Heads of ministerial-level agencies, Government agencies, Chairmen of People's Committees of provinces and centrally-run cities are responsible for implementing this Plan, ensuring progress, quality, efficiency, economy, avoiding formality and waste.

In the Plan, the appendix on the lists and the assignment of the drafting agency has also been detailed, such as assigning the Ministry of Industry and Trade as the agency in charge of drafting the Decree detailing a number of articles on the development of renewable energy and new energy electricity (amended and supplemented from time to time); Circular regulating the competitive retail electricity market; Decision on specific pricing of natural gas transportation services by pipeline and services of storing, re-converting, transporting and distributing liquefied natural gas for electricity production (issued by the Ministry of Industry and Trade); Decision on assigning enterprises in which the State holds 100% of the charter capital or enterprises in which this enterprise holds 100% of the charter capital as investors of power source projects and works, emergency power grids specified in Clause 2 and Clause 3, Article 14 of the Electricity Law (issued by the Prime Minister)...
