In 2022, Ms. Phuong quit her job and received unemployment benefits for 3 months, from July 2022 to September 2022. September 2022 was the last month she received unemployment benefits and she received them before re-joining social insurance (SI) at the new company.
However, in 2024, Ms. Phuong unexpectedly received a notice to return 1 month of unemployment insurance benefits to the Social Insurance Agency (September 2022). Ms. Phuong did not understand why her September 2022 benefits were revoked because at this time she was still on probation at the new company.
According to Vietnam Social Security, at the time Ms. Phuong is determined to have a job (September 2022), her unemployment benefits will be terminated.
However, because Ms. Phuong received her last month's unemployment benefits through her bank account, her new company then signed a labor contract and paid social insurance for her in September 2022.
At this time, the social insurance system recorded that the month of social insurance payment coincided with the month of receiving benefits, meaning that Ms. Phuong had received unemployment benefits in violation of regulations and had to be withdrawn.
According to Ms. Nguyen Van Hanh Thuc, Director of the Ho Chi Minh City Employment Service Center, there are quite a few cases of receiving unemployment benefits in violation of regulations and having to be revoked like Ms. Phuong.
The reason for this situation is that workers lack understanding of unemployment insurance laws, are unclear about cases where unemployment benefits are stopped, and do not promptly notify the Employment Service Center when they have a new job...
Some workers even deliberately hide the fact that they have a job to continue receiving unemployment benefits; or agree with the company's human resources department to work but not pay social insurance during the period of receiving unemployment benefits.
According to statistics from the Ho Chi Minh City Employment Service Center, in the first 6 months of 2024, the center discovered 712 cases of workers receiving TCTN benefits in violation of regulations. After many months of coordination with the Ho Chi Minh City Social Insurance, the center recovered more than 6.1 billion VND in incorrect unemployment insurance benefits.

According to Mr. Tran Dung Ha, Deputy Director of Ho Chi Minh City Social Insurance, due to the lack of labor information, which has not been digitized and data has not been synchronized between sectors, it is very difficult to control the employment status of workers. This leads to time differences, and cases of workers receiving unemployment benefits in violation of regulations as above.
In addition, it is often very difficult to recover the wrong amount of benefits from employees. The Social Insurance Agency must go through the employer, or notify the recovery of the wrong amount of benefits when the employee registers for unemployment benefits for the next time.
Therefore, Ms. Nguyen Van Hanh Thuc recommended that when amending the Law on Employment, there should be regulations on the recovery of unemployment benefits when employees receive them incorrectly so that management agencies can easily implement them.
