Delegate Nguyen Quang Huan said that people whose land is recovered need a better living environment, not necessarily a bigger house and a wider road.
Discussing the draft Land Law (amended) at the National Assembly on the morning of June 21, delegate Nguyen Quang Huan (Vice President of the Vietnam Association of Private Entrepreneurs) said he disagreed when the drafting committee removed the principle that "people whose land is recovered must have a place to live, ensuring a life equal to or better than their old place of residence".
"The drafting committee explained the removal of this principle because there were many different opinions, but in my opinion, such an explanation does not correctly understand the spirit of Resolution 18 of the Central Committee," Mr. Huan said.
According to the delegate of Binh Duong province, the content of the Central Resolution 18 on land policy should not be understood literally as people must have bigger houses, wider roads, and higher income. Whether people's lives in the new place are better or not requires many evaluation indicators such as better living environment, children being well educated. This needs to be done through sociological investigation using direct interview method.

Mr. Huan said that because of a misunderstanding of the policy in the Central Resolution, the Drafting Committee proposed that agricultural land recovery could also be compensated with housing. Such a regulation only cares about their specific income and not their livelihood, while people losing agricultural land means losing their livelihood.
"People are compensated with housing, but without daily jobs, their lives will be worse. At some point, they will sell the compensated house to spend money and become homeless," Mr. Huan analyzed.
He suggested that the Drafting Committee study some projects and study Resolution 18 to explain it to voters again. We cannot abandon the principle that "people whose land is recovered have a life equal to or better than their previous place because of a few opinions, because this is a step backwards".
Delegate Thach Phuoc Binh, Deputy Head of Tra Vinh Delegation, also raised some unclear points in the draft law related to determining damage, compensation and support when the State reclaims land.

"The issue of supporting people to move, rent for temporary housing, stabilizing life, vocational training... are the losses that people whose land is recovered must bear. The State must compensate, not consider it support," said Mr. Binh.
He also suggested that the Drafting Committee pay attention to the legitimate rights and interests of the people, ensuring that the compensation value is closer to the market price. When the State reclaims land, it must clarify the responsibility and accountability, ensuring the harmony of interests of the three parties: the State, the people, and the investors.
Regarding compensation and site clearance, Director of the Hanoi Department of Transport Nguyen Phi Thuong presented the practical implementation of the Ring Road 4 in the capital region. He said that separating site clearance into a separate project has been effective, contributing to speeding up progress.
Nearly a year after the National Assembly passed a resolution approving the investment policy, site clearance work has reached 81.5%.

The draft mentioned separating compensation and resettlement support into independent projects, but Mr. Thuong said that "it is still general and not really clear". He suggested specifying the cases where compensation and resettlement support can be separated into independent projects for the investment decision maker to decide.
In addition, Mr. Thuong suggested considering reducing the number of days to complete some procedures related to compensation, support, resettlement, and land acquisition to shorten project implementation time.
