The 2009 Law on the Elderly and the 2019 Labor Code lack consistency in regulations on the age of the elderly. However, this content is waiting for time to be adjusted.
Many elderly people in Ha Tinh city often walk and sightsee in Uncle Ho Memorial Area when visiting Ha Tinh.
Article 2 of the 2009 Law on the Elderly stipulates the following about the elderly: “The elderly defined in this law are Vietnamese citizens aged 60 years or older.”
Meanwhile, according to the provisions of the Labor Code that will take effect from January 1, 2021, the retirement age of employees from 2021 will increase.
Article 169, Clause 2 of the Labor Code stipulates: “The retirement age of employees in normal working conditions is adjusted according to the roadmap until reaching 62 years of age for male employees in 2028 and 60 years of age for female employees in 2035. From 2021, the retirement age of employees in normal working conditions is 60 years and 3 months for male employees and 55 years and 4 months for female employees; after that, each year it increases by 3 months for male employees and 4 months for female employees”.
The Elderly Association of Thach Ha district organized the first elderly singing festival in 2023.
Accordingly, for male workers, the retirement age under normal working conditions will be specified as follows: from 2021: 60 years and 3 months; 2022: 60 years and 6 months; 2023: 60 years and 9 months; 2024: 61 years; 2025: 61 years and 3 months; 2026: 61 years and 6 months; 2027: 61 years and 9 months; from 2028 onwards: 62 years.
Faced with this inadequacy, many elderly voters in Ha Tinh have petitioned the Ha Tinh National Assembly to adjust and amend the inadequacy. Deputy Head of the Ha Tinh National Assembly Delegation - Tran Dinh Gia said: Regarding this content, the Ha Tinh National Assembly Delegation has sent a document to the National Assembly to review and amend Decision No. 972/QD-BNV, dated March 24, 2017 of the Ministry of Home Affairs approving the Charter of the Vietnam Association of the Elderly, which stipulates raising the age of people eligible to join the association from 60 years old to 62 years old, ensuring compliance with the retirement age regulations in the Labor Code (amended). Based on the document sent by the Petition Committee, the Ministry of Home Affairs has recently sent a document responding to the Ha Tinh National Assembly Delegation.

According to the document provided by the Ha Tinh National Assembly Delegation, the Ministry of Home Affairs affirmed: On January 14, 2022, the 6th National Congress of the Vietnam Association of the Elderly approved the amendment and supplement to the Association's Charter approved with Decision No. 972/QD-BNV, dated March 24, 2017 of the Minister of Home Affairs.
Based on the proposal of the Vietnam Association of the Elderly, the Ministry of Home Affairs coordinated with relevant agencies to issue Decision No. 288/QD-BNV, dated April 6, 2022, approving the Charter (amended and supplemented) of the association to ensure compliance with the provisions of the Law on the Elderly and the law on associations.
Mr. Dang Van Hung (65 years old, member of the Elderly Association of Lien Tan village, Thuong Loc commune, Can Loc) is always exemplary in the general movement of the village and commune.
Along with the above content, the document of the Ministry of Home Affairs also clearly states: Pursuant to Clause 2, Article 28 of the Law on the Elderly and Clause 2, Article 214 of the Labor Code, the Ministry of Labor, Invalids and Social Affairs assists the Government in implementing state management of the elderly and labor. Currently, the Ministry of Labor, Invalids and Social Affairs is presiding over and coordinating with agencies to research and amend the Law on the Elderly.
On July 10, the People's Committee of Huong Khe district honored 17 elderly people with good economic performance, typical of the period 2018 - 2023.
It is known that the Ministry of Home Affairs has also forwarded the content of the Ha Tinh National Assembly Delegation's proposal to the Ministry of Labor, Invalids and Social Affairs for research, consultation with competent authorities for consideration, decision and ensuring consistency with the Labor Code.
Chairman of the Ha Tinh Elderly Association Thai Sinh said: The Law on the Elderly was issued a long time ago, but now there are shortcomings, including policy provisions. The law is also currently lacking in consistency with some newly issued documents. According to the results of work and directive documents, from the Central, the National Assembly to the Government are agreeing to revise the legal policy system for the elderly to be consistent with the newly issued documents; at the same time, consistent with the specific situation and conditions.
