Talkshow "Capital Law 2024: Realizing the Capital's aspirations to rise up" within the framework of "Media events bringing the Capital Law into life", on the occasion of the milestone of the Capital Law 2024 taking effect from January 1, 2025, with the participation of speakers: Master Dang Huy Dong - Former Deputy Minister of Planning & Investment, Director of the Institute for Planning and Development Studies; Prof. Dr. Hoang Van Cuong - National Assembly Delegate of the National Assembly of Hanoi City, Vice Chairman of the State Council of Professors for the term 2024 - 2029; Dr. Architect Dao Ngoc Nghiem - Vice Chairman of the Vietnam Urban Planning and Development Association.
The "key" to solving traffic congestion
Speaking at the Talkshow, Director of the Institute for Planning and Development Studies Dang Huy Dong assessed that the 2024 Capital Law creates many favorable conditions for the development of the urban railway system in Hanoi through specific mechanisms and policies. The 2024 Capital Law dedicates Article 31 to regulate urban development in the direction of public transport (TOD), including contents such as planning the urban railway system and TOD areas, investment in urban railway development and mechanisms for collecting surplus value fees from land in TOD areas. This helps create a solid legal basis for urban railway projects.
“The provisions in Article 31 of the Capital Law 2024 on urban development have a very big highlight that will change both the quality and quantity of Hanoi's urban development in the coming time. At the same time, we have high expectations for the policy of developing a mass public passenger transport system in the Capital Law. This mechanism gives Hanoi the right to take ownership and decide on the entire urban railway project, helping to speed up progress. Hanoi can proactively complete the entire urban railway system. With the Capital Law applied, Hanoi can complete the set goal of urban railway development,” said Mr. Dang Huy Dong.
According to the Director of the Institute for Planning and Development Studies, Dang Huy Dong, compact urban areas can only be developed in places where public transport passes through. Real estate from these compact urban areas will increase in value, creating capital to develop public transport. If a city with a population of 3 million or more develops mixed transport, it will lead to traffic congestion. Therefore, it is necessary to limit personal vehicles, that is a mandatory choice. To do that, it must be supported by the people. "People must highly agree with the government to limit personal vehicles, however, for people to support, the State must meet people's travel needs by public transport" - Mr. Dang Huy Dong expressed his opinion.
At the same time, Director of the Institute for Planning and Development Research Dang Huy Dong shared: “I take the urban railway, from Cat Linh Station to Ha Dong Station it only takes more than 10 minutes, this proves that the elevated urban railway is very convenient. However, there needs to be a synchronous public transport system. The public transport levels are urban railway, bus, taxi and small tram will ensure to cover the travel needs of the people”.
Meanwhile, Dr. Architect Dao Ngoc Nghiem suggested clarifying the TOD model. “We need to learn to unify; because Vietnam is different from other countries, and Hanoi is even more special, because Hanoi has a rich heritage fund. The 2024 Capital Law assigns the City People's Committee to choose the TOD location, this is a big responsibility because Hanoi has many historical relics. Where we choose the location, how to get people to come and enjoy it is a challenge and a huge responsibility" - Dr. Architect Dao Ngoc Nghiem emphasized.
Opening the door to sustainable planning and development
As the person directly in charge of the planning of the Capital and directly participating in giving opinions during the process of building and passing the Capital Law 2024, Prof. Dr. Hoang Van Cuong - National Assembly delegate of the National Assembly Delegation of Hanoi City, Vice Chairman of the State Council of Professors for the 2024 - 2029 term said that large cities in the world all develop urban areas on both sides of the river, but we have not been able to do that with the Red River, while it is a prime area with potential for economic development. Or for the old quarter, where the economic value is very high, but has the disadvantage of being narrow and crowded, affecting the quality of life of the people, as well as environmental issues...
“This time we have the Capital Law 2024, which is an important institutional step forward, creating a legal framework to solve this problem. It can be said that riverside metropolises will become a trend of the new era, helping to promote cultural and ecological values and unleash the potential for service economic development,” shared Prof. Dr. Hoang Van Cuong.
Prof. Dr. Hoang Van Cuong gave an example, regarding the planning of the Red River, the 2024 Capital Law allows the exploitation of both banks of the Red River to develop cultural industry, still complying with the requirements of flood safety, but we are still allowed to build and exploit commercial and service works. In particular, it allows the development of the West of the Red River to become a heritage road. There will be a reproduction of the entire story of history, culture, and people of the country, along with business and service activities to serve the people and tourists. From there, a cultural space will be created, and traditional festivals of 63 provinces and cities will be focused on there.
“In particular, through this planning work, the Red River can provide water for the river systems in the inner city (To Lich River, Set River...) which will help clean up and revive the “dead rivers” in the inner city. Thus, we have a clear mechanism to exploit the potential of the Red River. In the future, the Red River will become an axis of landscape, culture, and services, at which time we will truly have a city by the river” - Professor, Dr. Hoang Van Cuong emphasized.
Meanwhile, Dr. Architect Dao Ngoc Nghiem - Vice President of the Vietnam Urban Planning and Development Association commented that, through statistics, the Capital Law 2024 has up to 14 - 15 specific policies on planning; especially decentralization and delegation of power to Hanoi is very large.
“For example, in the past when we were working in Hanoi, to adjust a planning approved by the Prime Minister, we had to go through all ministries and branches, which was very difficult. This time, the National Assembly gave Hanoi the right to decide to adjust the planning if there was enough basis, this is a great advantage in terms of mechanism. At the same time, the city is decentralized and delegated power, of course, it must do it itself, take responsibility for itself, just as the Central Committee is emphasizing: "locality does, locality decides, locality takes responsibility". At the same time, with the specific planning characteristics in the Capital Law on developing public space, underground space, these areas, Hanoi has gone early, now it needs to continue to implement to meet practical requirements..." - Dr. Architect Dao Ngoc Nghiem informed.
Assessing the development opportunities of the Capital, when Hanoi has had extremely valuable orientations, which are the Capital Law 2024 and major plans, especially the Capital Planning established with "new vision - new global thinking, Capital thinking and Hanoi action" approved, Dr. Architect Dao Ngoc Nghiem said, currently, we are synchronously implementing the plans, this is the flexibility of the mechanism of Hanoi City - a sharp tool to organize the implementation of the Capital Law 2024. Regarding planning work, the Capital Law has many regulations on specific mechanisms and policies, such as planning adjustment, project approval, selection of investors, resource determination, etc.
“It can be said that in the Capital Law 2024, planning work is an important area that receives attention. I believe that if we fully understand the responsibilities assigned by the State, with the spirit of self-determination, self-doing, and self-responsibility, we will bring the Capital to new heights. In the coming time, Hanoi needs to continue to specify the issues in the specific policies identified in the Capital Law 2024 to create breakthroughs and strong development for the Capital in the new era,” Dr. Architect Dao Ngoc Nghiem emphasized.
On December 31, the Economic & Urban Newspaper organized a launch of media events to bring the Capital Law into life, marking the milestone of the Capital Law 2024 coming into effect from January 1, 2025. In which, the Talkshow "Capital Law 2024: Realizing the Capital's aspirations to rise" is the opening event for a series of newspaper events held at Hanoi Book Street. At the same time, at this event, the Newspaper organized a photo exhibition with the theme "Hanoi's rise and breakthrough"; introduced a reportage on the Capital Law 2024 and documents guiding its implementation; introduced a reportage on the Capital Planning for the period 2021-2030, with a vision to 2050".
The Capital Law No. 39/2024/QH15 was passed by the 15th National Assembly, 7th Session on June 28, 2024, consisting of 7 chapters and 54 articles (an increase of 3 chapters and 27 articles compared to the 2012 Capital Law), closely following the 5 guiding viewpoints for drafting the Law and 9 policy groups decided by the National Assembly with many new contents, aiming at strong decentralization and delegation in all fields along with many specific and outstanding policy solutions, suitable to the practical situation, development orientation of the country, and of the capital Hanoi in the new period. The Law takes effect from January 1, 2025 (except for 5 contents taking effect from July 1, 2025), replacing the Capital Law No. 25/2012/QH13.
The 2024 Capital Law has fully institutionalized the specific mechanism for the Capital to make a breakthrough, implementing the goals of Resolution No. 15-NQ/TW dated May 5, 2022 of the Politburo "on the direction and tasks of developing the Capital Hanoi to 2030, with a vision to 2045", which has determined that by 2030, the Capital Hanoi will be a "Cultured - Civilized - Modern" city, becoming the center and driving force for the development of the Red River Delta, the key economic region of the North and the whole country...
To concretize and put the Capital Law 2024 into practice, at 2 sessions of the Hanoi People's Council, 17 Resolutions of the City People's Council on implementing the Capital Law with regulations under its authority were passed. In addition, there are currently more than 30 Resolution submissions registered by the city's departments, branches and sectors to submit to the City People's Council for consideration and approval at the upcoming sessions. Along with that, the Hanoi People's Committee is actively coordinating with ministries, branches and sectors to advise on draft decrees, resolutions and decisions guiding the implementation to concretize the contents and provisions of the law. Recently, the Government issued Decree No. 169/2024/ND-CP detailing the organization and operation of the People's Committees of wards in Hanoi.
Under the direction of the City Party Committee, Hanoi also promotes propaganda work so that officials and people clearly understand the provisions of the Capital Law; implement the contents of the Law synchronously and effectively. In particular, from January 1, 2025, Hanoi will launch a peak propaganda campaign on the Capital Law and documents guiding the implementation of the Law throughout the city, with the participation of all levels, sectors and especially the capital's press agencies in accordance with Directive No. 37-CT/TU dated December 6, 2024 of the Standing Committee of the Hanoi City Party Committee on implementing the Capital Law.
