The leader of the Thuy Nguyen District Construction Investment Project Management Board admitted that there was a practice of "straightening the road first, legalizing the planning later" in this important construction project.
The investment project to build the southern ring road of Thuy Son commune, Thuy Nguyen district, Hai Phong city was approved for investment in 2020, has been put into use and is undergoing acceptance and settlement procedures.
Fast project approval
According to the records, on December 1, 2020, the People's Committee of Thuy Nguyen district submitted a request for investment policy for the project.
The Standing Committee of Thuy Nguyen District Party Committee met and issued a notice: Agreeing in principle to allow the District People's Committee to invest in the project.
Just one day later, on December 2, the People's Council of Thuy Nguyen district issued a Resolution and decided on the investment policy.
After that, the People's Committee of Thuy Nguyen district sent a document to the Hai Phong Department of Transport requesting appraisal of the investment project to build the southern ring road of Thuy Son commune.
The Department of Transport has a document assessing the response of Thuy Nguyen district. This Department requested Thuy Nguyen to renegotiate with the Department of Agriculture and Rural Development on the aperture and size of the cross-road culverts, according to the previous request and guidance of the Department of Agriculture and Rural Development and the Department of Construction.
After receiving comments from the Department of Transport, the People's Committee of Thuy Nguyen district issued Decision No. 9303/QD-UBND approving the Investment Project to build the southern ring road of Thuy Son commune.
"Straighten the road" first, legalize the procedures later
The appraisal opinion of the Department of Agriculture and Rural Development sent to Thuy Nguyen district stated: The implementation of the southern boundary road of Thuy Son commune will cause the loss of 49,276 square meters of agricultural land and requested the district to pay attention to the agricultural land use quota that the city has allocated to this district.
The Department of Natural Resources and Environment also requires additional land use planning.
At the time of project implementation, these requirements were not implemented.
Document No. 4721 of the Department of Natural Resources and Environment dated December 15, 2020 stated that at that time, Thuy Nguyen district was implementing the Land Use Planning for the period 2021-2030 and the Land Use Plan for the first period 2021-2025 for the land fund included in the project. The Department of Natural Resources and Environment requested the People's Committee of Thuy Nguyen district to determine the specific location and area of land for project implementation, and report to competent state agencies for approval.
Following this instruction, Thuy Nguyen district immediately added it to the new period land fund planning to “legalize”. However, it will not be officially approved until 2022.
On the other hand, the direction of the route was not included in the general planning of Nui Deo town at the time of project implementation.
The current road boundaries do not completely match the boundaries in the planning that the functional units previously approved for this project.
The Hai Phong Department of Construction in a document sent to the Hai Phong Department of Transport on December 21, 2020 also stated: This route is the southwest ring road of Nui Deo town, part of the infrastructure framework identified in the General Plan for City Construction to 2025, with a vision to 2050 according to Decision No. 1448/QD-TTg dated September 16, 2009 of the Prime Minister.
"Through comparison, the route direction according to the proposal of the People's Committee of Thuy Nguyen district has been adjusted compared to the General Planning of Nui Deo town and the expansion to 2035, with a vision to 2050 approved by the City People's Committee in Decision No. 1401/QD-UBND dated June 21, 2018," the Department of Construction stated.
"As analyzed above, this route has changed compared to the approved master plan of Nui Deo town. The adjustment of this master plan is under the authority of the City People's Committee after receiving consensus from the Standing Committee of the City Party Committee. Therefore, the implementation of the project must make local adjustments to the master plan of Nui Deo town before implementation," the Department of Construction affirmed.
According to regulations, the adjustment of the route is under the approval authority of the Standing Committee of the Hai Phong City Party Committee. The City Party Committee agreed to direct the Hai Phong City People's Committee to approve the adjustment. After obtaining the consensus of the City People's Committee, the Department of Construction is authorized to issue documents to guide the district to implement according to regulations.
Talking to VietNamNet reporter, Director of Thuy Nguyen District Construction Investment Project Management Board Pham Van Hao also admitted that the investment procedures for the construction of the southern ring road project of Thuy Son commune had some limitations in planning procedures, and the alignment of this route was done without the consent of Hai Phong City People's Committee.
Mr. Hao said: “There are some ideas that we can implement immediately, and some that we will implement during the project implementation process. By the time the road is put into use, the missing procedures have been completed, in accordance with the new regulations and without causing any consequences.”
The southern ring road project of Thuy Son commune is one of four important public investment projects for the socio-economic development of Thuy Nguyen district, Hai Phong, approved at the 16th session of the People's Council of Thuy Nguyen district, term XVIII, term 2016-2021.
After completion, the project will serve the travel needs of Thuy Nguyen residents, contribute to promoting economic development, and ensure synchronous development of traffic infrastructure in Thuy Nguyen district.
However, this "first act, later report" approach can create a bad precedent in implementing investment projects in the area, complying with administrative discipline, and cause mixed opinions from local public opinion.
The consortium of Dung Thang Transport Trading Joint Stock Company and Thong Nhat Water Supply and Construction Joint Stock Company is the unit that won the bid to construct the above project, the project implementation period is 200 days. The decision was issued by the Thuy Nguyen District Investment and Construction Project Management Board on June 29, 2021. The two enterprises in the winning joint venture are both based in Hai Phong, but are quite secretive. Public information from the national bidding network shows that the joint venture of Dung Thang Transport Trading Joint Stock Company and Thong Nhat Water Supply and Construction Joint Stock Company has won many large and small bid packages in the past 4 years invited by the Thuy Nguyen District Investment and Construction Project Management Board. |
