Expected to remove many regulations related to banning extra tutoring

The Ministry of Education and Training has just announced the draft Circular on Regulations on extra teaching and learning on the Ministry's electronic information portal to collect comments. The deadline for comments is October 22, 2024.

This draft circular, once approved, will replace Circular No. 17 dated May 16, 2012 promulgating Regulations on extra teaching and learning.

The new point of the draft Circular is that it does not stipulate cases where extra teaching is not allowed as in Article 4 of Circular 17.

Accordingly, Article 4 of Circular 17 stipulates the following cases where extra teaching is not allowed:

- No extra teaching for primary school students, except in the following cases: art training, physical education, life skills training.

- Universities, colleges, vocational schools and vocational training schools do not organize additional teaching and learning of contents according to the general education program.

- For teachers receiving salary from the salary fund of public service units:

+ Not allowed to organize extra teaching or learning outside of school but can participate in extra teaching outside of school;

+ Teachers are not allowed to teach extra classes outside of school for students they are teaching in the regular curriculum without the permission of the Head of the agency that manages that teacher.

According to the new regulations in the draft, the professional group will hold a meeting to agree on proposals to the head of the school (Principal) for additional teaching and learning for subjects undertaken by the professional group. For subjects proposed for additional teaching and learning, the reasons, objectives, content, proposed duration of additional teaching and learning, and the list of teachers registered to teach additional teaching by subject in each grade must be clearly stated.

The principal, based on the proposal of the professional groups, organizes a meeting with the school leaders, heads of the professional groups, and representatives of the school's Parents' Association to agree on the organization of extra teaching and learning in which subjects and in which grades, ensuring practicality, fairness, transparency, and for the benefit of students.

Total teaching time and organization of educational activities according to the school's educational plan and extra teaching and learning must not exceed 35 periods/week for primary school, not more than 42 periods/week for middle school, and not more than 48 periods/week for high school.

The principal, based on the wishes of the students, develops a plan to organize extra teaching and learning (class placement, teacher assignment, and timetable for each subject in each grade). Report to the direct management agency before organizing extra teaching and learning. The school's plan to organize extra teaching and learning is made public on the school's website and notified to parents.

The new point of the draft Circular emphasizes the role of professional groups in teaching and learning extra subjects undertaken by professional groups.

Circular 17 of 2012 stipulates that students who wish to take extra classes must write an application to the school; parents or guardians whose children wish to take extra classes must directly sign and make a commitment to the school.

According to the draft, organizations or individuals doing business in extra-curricular teaching and learning activities outside of schools (hereinafter referred to as extra-curricular teaching establishments) must register their business in accordance with the provisions of law. Publicize the subjects that are organized for extra-curricular teaching and learning, the duration of extra-curricular teaching of each subject by grade level, the location and time of organizing extra-curricular teaching and learning, the list of extra-curricular teachers and the tuition fees before enrolling students for extra-curricular teaching and learning classes.

Teachers (including Vice Principals or their deputy heads) of public schools who participate in extracurricular teaching must report to the Principal about the subjects, locations, and times of extracurricular teaching and commit to the Principal to complete assigned tasks and not violate regulations.

In case a teacher's extracurricular class includes students from the class that the teacher is directly teaching at school, he/she must report and make a list of those students to the Principal and commit not to use any form of coercion to force students to take extra classes.

Principals who participate in extra-curricular teaching must report to and receive approval from the Head of the Department of Education and Training (for junior high schools) and the Director of the Department of Education and Training (for high schools).
