The provincial National Assembly delegation discussed and commented on the draft Law on Promulgation of Legal Documents.

(Baoquangngai.vn) - Delegate Luong Van Hung, National Assembly Delegation of Quang Ngai province expressed his high consensus with the draft Law on Promulgation of Legal Documents submitted by the Government to the National Assembly.

On the afternoon of February 13, at the plenary session of the National Assembly in the Hall, Deputy Chief Justice of the People's Court of Quang Ngai province Luong Van Hung, the National Assembly Delegation of Quang Ngai province, spoke to discuss and give comments on the draft Law on Promulgation of Legal Documents.

Delegate Luong Van Hung expressed his agreement with the draft Law on Promulgation of Legal Documents submitted by the Government to the National Assembly and commented on a number of contents related to the organization and operation of the People's Court. Regarding the authority of the Supreme People's Court Judicial Council to issue a resolution guiding the trial work, Delegate Luong Van Hung proposed to review and revise the content of the provision in Clause 1, Article 16 of the draft law as "The Supreme People's Court Judicial Council issues a Resolution guiding the unified application of law in trial" to be consistent with the provisions of the Law on Organization of People's Courts 2024.

Regarding the validity of legal documents, delegate Luong Van Hung said that in reality, there are a number of current laws and resolutions that stipulate that the simplified procedure takes effect from the date the law is promulgated. Therefore, to ensure compliance with current legal regulations and cover all cases, it is proposed to stipulate that "Legal documents are developed and promulgated according to the simplified procedures or in special cases may take effect from the date of adoption, signing or promulgation".

In addition, delegate Luong Van Hung suggested that the issuance of documents guiding the application of legal documents must ensure the principles and criteria stipulated in this law and must not set new regulations; at the same time, agencies and individuals with the authority to issue legal documents should not guide the application of documents issued by themselves using administrative documents, in order to ensure the legal basis for the Court to apply in the process of adjudication and dispute resolution.
