Today, February 15th, the National Assembly held group discussions on the draft Resolution on piloting a number of policies to remove obstacles in national science , technology, innovation, and digital transformation activities. Raising the issue during the discussion session, delegate Hoang Duc Thang emphasized: Based on the summary of the draft Resolution on Piloting some policies to remove obstacles in national science, technology, innovation and digital transformation activities, the resolution only focuses on removing obstacles, meaning it only addresses immediate problems.
Meanwhile, creating a legal framework to promote the development of science and technology, innovation, and national digital transformation is also a crucial and sustainable issue.
Based on that, the delegates proposed that the drafting agency consider supplementing and adjusting the summary of the draft Resolution to include "Piloting a number of policies to remove obstacles and promote national science, technology, innovation and digital transformation activities."
Regarding Article 2 on the scope of application, which stipulates that "This Resolution applies to organizations and individuals engaged in national science, technology, innovation, and digital transformation activities, and other related organizations and individuals," Representative Hoang Duc Thang argued that science, technology, innovation, and digital transformation are achievements and a powerful global revolution. Therefore, it is necessary to consider whether the scope of application should be limited to within Vietnam or expanded to include entities outside Vietnam that have cooperative and developmental relationships with Vietnam.
This is a crucial legal framework for promoting investment attraction and technology transfer. Therefore, we propose that the drafting agency consider and add a group of policy mechanisms to encourage international cooperation, support, and development of science and technology, innovation, and national digital transformation.
Regarding Clause 1, Article 18 on the Implementation Clause, which stipulates that “This Resolution shall take effect from February 2025 and shall cease to be effective when the Law on Digital Technology Industry; the Law on Science, Technology and Innovation come into effect or when the pilot period stipulated in this Resolution expires,” Representative Hoang Duc Thang suggested that the drafting agency reconsider and reassess the effective date of the resolution to ensure its appropriateness. He argued that the pilot period of the resolution and the potential effective dates of the Law on Digital Technology Industry and the Law on Science, Technology and Innovation could lead to limitations for relevant individuals and organizations in the implementation process later on.

Participating in the discussion, delegate Nguyen Huu Dan, Commander of the Quang Tri Provincial Military Command, stated that: In recent times, the implementation of laws on science and technology and innovation has achieved many remarkable achievements.
However, in practice, some aspects still do not meet the requirements, such as: (i) obstacles related to the autonomy of public science and technology organizations; (ii) the lack of regulations allowing civil servants and management staff to participate in enterprise activities to promote the commercialization of research results; (iii) the financial mechanism related to allocating state budget funds for science and technology research activities remains complex... Therefore, the issuance of a Resolution piloting some policies to remove obstacles in national science, technology, innovation and digital transformation activities is extremely necessary.
Specifically, delegate Nguyen Huu Dan suggested that the drafting agency consider adjusting and supplementing the provisions in Article 6 of the draft as follows: "Organizations and individuals engaged in scientific research and technological development activities shall be exempt from civil liability in cases where damage occurs to the State during the implementation of scientific research and technological development projects if those organizations and individuals have fully complied with the procedures and regulations on scientific research and ensured that the research objectives and scope are in accordance with the set objectives."
Adding the condition of "ensuring that the research adheres to the stated objectives and scope" will contribute to enhancing the responsibility of organizations and individuals in carrying out scientific research and technological development projects; at the same time, it will help minimize research risks and waste of state budget funds allocated to these research activities.
Regarding the provision in point a, clause 1, Article 12 on "Development of Strategic Technologies," which stipulates that a technology is considered strategic when it "creates a breakthrough in promoting economic growth and enhancing national competitiveness," while point b, clause 2 of the same article states that a strategic technology product is a high-tech product that meets the condition of "Supporting the achievement of strategic goals in socio-economic development, national defense, security, and diplomacy."
Therefore, to ensure consistency in the eligibility criteria for strategic technologies and strategic technology products, the delegate suggested that the drafting agency should consider adding the following provision to point a, clause 1, Article 12: "Creating breakthroughs in promoting economic growth, solving prominent and complex issues in social life, and enhancing national competitiveness."
At the end of the discussion, delegate Hoang Duc Thang, head of the discussion group, highly appreciated and acknowledged the opinions of the National Assembly deputies.
