Today, February 15, the National Assembly discussed in groups the draft Resolution on piloting a number of policies to remove obstacles in science, technology, innovation and national digital transformation activities. Raising the issue at the discussion session, delegate Hoang Duc Thang emphasized: Through the summary of the draft Resolution on Piloting a number of policies to remove obstacles in science, technology, innovation and national digital transformation activities, it shows that the resolution only focuses on removing obstacles, meaning it only solves immediate problems.
Meanwhile, creating a legal corridor to promote the development of science and technology, innovation and national digital transformation is also an important and sustainable issue.
On that basis, the delegates proposed that the drafting agency consider, supplement, and adjust the summary of the draft Resolution into Piloting a number of policies to remove obstacles, promote scientific and technological activities, innovation, and national digital transformation.
Regarding the provisions in Article 2 on the subjects of application, which stipulates that "This Resolution applies to organizations and individuals engaged in science, technology, innovation and national digital transformation activities and other relevant organizations and individuals", delegate Hoang Duc Thang said that science, technology, innovation and digital transformation activities are achievements and a strong revolution of global significance, so it is necessary to consider whether the subjects are only applicable in Vietnam or to expand to subjects outside Vietnam but have a cooperative and development relationship with Vietnam.
This is an important legal corridor in promoting investment attraction and transfer of science and technology. Therefore, it is recommended that the drafting agency consider and supplement a group of policy mechanisms to encourage international cooperation, support, development of science and technology, innovation and national digital transformation.
In Clause 1, Article 18 on the Implementation Provisions stipulates that "This Resolution takes effect from... February 2025 and expires when the Law on Digital Technology Industry; Law on Science, Technology and Innovation comes into effect or the pilot period prescribed in this Resolution expires", delegate Hoang Duc Thang requested the drafting agency to review and re-evaluate the effective period of the resolution accordingly, because the pilot period of the resolution according to regulations and the fact that the Law on Digital Technology Industry, Law on Science, Technology and Innovation may come into effect at different times will lead to limitations for relevant individuals and organizations in the implementation process later.

Participating in the discussion, delegate Nguyen Huu Dan, Commander of the Quang Tri Provincial Military Command, said: In recent times, the implementation of laws on science, technology and innovation has achieved many remarkable achievements.
However, in practice, there are still some contents that are not suitable to the requirements such as: (i) problems related to the autonomy of public science and technology organizations; (ii) there are no regulations allowing officials and managers to participate in business activities to promote the commercialization of research results; (iii) the financial mechanism related to the allocation of state budget funds for science and technology research activities is still complicated... Therefore, the issuance of a Resolution to pilot a number of policies to remove obstacles in science, technology, innovation and national digital transformation activities is extremely necessary.
Giving specific comments, delegate Nguyen Huu Dan suggested that the drafting agency consider, adjust and supplement the provisions in Article 6 of the draft as follows: "Organizations and individuals engaged in scientific research and technological development activities are exempted from civil liability in case of causing damage to the state in the process of implementing scientific research and technological development topics if such organizations and individuals have fully implemented the procedures and regulations on scientific research and ensured compliance with the proposed objectives and scope of research".
Adding the condition of "ensuring compliance with the proposed research objectives and scope" will contribute to enhancing the responsibility of organizations and individuals in implementing scientific research and technology development topics; at the same time, it will help reduce risks in research and waste of state budget funds spent on these research activities.
Regarding the provisions at Point a, Clause 1, Article 12 on “Development of strategic technology”, it stipulates the conditions for being considered strategic technology when “creating a breakthrough in promoting economic growth and enhancing national competitiveness”, while at Point b, Clause 2 of this Article, it states that strategic technology products are high-tech products when meeting the condition of “Supporting the achievement of strategic goals on socio-economy, national defense, security, and diplomacy”.
Therefore, to ensure consistency in the conditions for meeting strategic technology and strategic technology products, delegates suggested that the drafting agency should consider and supplement the provisions at Point a, Clause 1, Article 12 as follows: "Create breakthroughs in promoting economic growth, solving outstanding and complicated issues in social life and enhancing national competitiveness".
At the end of the discussion, delegate Hoang Duc Thang, Head of the discussion group, highly appreciated and acknowledged the opinions of the National Assembly deputies.
