On November 27, the National Assembly discussed the draft Law on Employment (amended). One of the contents attracting discussion was the regulation on unemployment insurance contributions and benefits.
Enjoy 60% not enough to cover personal living expenses
Delegate Dieu Huynh Sang (Binh Phuoc) is interested in the unemployment benefit level equal to 60% of the average monthly salary for the last 6 months of social insurance contributions.
In fact, with the above unemployment benefits, workers do not have enough to cover living expenses, not to mention taking care of their families.

Meanwhile, the salary of enterprises participating in social insurance is mostly based on the regional minimum wage, about more than 4 million VND/month and the unemployment benefit is only about 2.5 million VND.
"I propose that the drafting committee study regulations to increase the monthly unemployment benefit from 60% to 75% of the average monthly salary to suit the reality of life," said delegate Dieu Huynh Sang.
In addition, she also proposed to remove the regulation that the maximum unemployment benefit period is no more than 12 months.
According to the delegate, social insurance is implemented according to the principle of "contribute and receive", "contribute to the extent and receive to that extent" and is unlimited to be compatible with the 2019 Labor Code on severance pay.
Delegate Nguyen Hoang Bao Tran (Binh Duong) also proposed increasing the unemployment benefit level to 70% of the average monthly salary for the 6 most recent months of social insurance contributions before becoming unemployed.
The monthly benefit is not lower than the regional minimum wage but not more than 5 times the regional minimum monthly wage announced by the Government in the last month of paying social insurance. This is to support workers to have a stable source of income, ensure family life, focus on finding a job without worrying about financial pressure.
It is unreasonable to pay without receiving benefits.
Delegates from Binh Duong province were also concerned about Article 64 of the draft Law, which added and excluded 4 groups of subjects who are not entitled to unemployment benefits. In particular, in cases where employees unilaterally terminate their contracts; are fired; are disciplined or forced to quit their jobs, they are not entitled to unemployment benefits.
“I think this content will be disadvantageous for workers. In reality, there are many cases where workers have fully paid social insurance but cannot receive it due to force majeure. Sometimes, workers violate discipline not entirely due to personal fault…”, the delegate analyzed.
Therefore, delegate Bao Tran proposed to review and regulate the conditions for receiving unemployment insurance to ensure the principle of contribution and benefit to balance and harmonize the rights of workers when unemployed.

Delegate Pham Van Hoa (Dong Thap) also said that the provisions of the bill are unreasonable for those who violate the law and are fired.
"It is unreasonable to not receive the money people have paid," delegate Hoa emphasized, adding that not allowing these people to receive unemployment benefits will make it very difficult for them in the future.
The delegate proposed a regulation that "you pay and you receive", "no matter who that person is, even if they are in prison, after they are released they must still receive benefits".
Explaining later, Minister of Labor, Invalids and Social Affairs Dao Ngoc Dung said he will continue to coordinate with research agencies to supplement, evaluate and absorb delegates' opinions to complete the draft law.

Delegate Truong Xuan Cu (Hanoi City) said that currently there are 15,000 professors, associate professors, over 25,000 PhDs and many Vietnamese professors have become famous in the world, receiving mathematics prizes almost equal to the Nobel Prize.
“We think that in the next era, we cannot only export labor but also experts,” said Mr. Cu.
According to the delegate, that shows the country's position and reputation and is the country's income. An expert's average salary is also 10,000 USD.
Mr. Cu said that in the 80s we exported experts to Africa, so we can continue to promote this.
"This issue must have a program, a plan for training, fostering, and coaching so that we can integrate with the international community," Mr. Cu emphasized.
