Kinhtedothi - To complete the Draft Law on Employment (amended), the Ministry of Home Affairs needs to pay attention to the content of developing vocational skills in the new era; developing occupations, vocational skills and the right to employment for those involved in the arrangement and streamlining of the organizational apparatus.
On the afternoon of March 25, at the 7th Conference of specialized National Assembly deputies, National Assembly deputies participated in the discussion on the Draft Law on Employment (amended).
Facilitate unemployment benefits
Participating in the discussion on the responsibility of reporting on job search of employees in the Draft Law, National Assembly delegate Nguyen Anh Tri (Hanoi City Delegation) said that Article 45 of the Draft Law stipulates that: during the period of receiving unemployment benefits, employees must go directly to the public employment service organization where they are receiving unemployment benefits every month to report on job search at the time of implementing digital transformation as it is now is not appropriate. Employees can report online, and to reduce the situation of fraudulent declarations, the most important thing is to have sanctions.
Sharing the same view, National Assembly delegate Nguyen Thi Viet Nga (Hai Duong Province Delegation) stated that we are actively promoting information technology in State management to resolve administrative procedures. Therefore, the regulation that employees must go directly to the employment service organization where they are receiving unemployment benefits to report their job search is not really appropriate.
"Many people think that coming to notify directly also helps beneficiaries receive advice, but if we only think of consulting as direct advice, we are going against the times. Because, nowadays there are too many means and different ways of job consulting that we encounter a lot in real life" - delegate Viet Nga said.
Concerned about the policy benefits when directly announcing job search, delegate Viet Nga said that the Draft Law has provisions on labor registration, national database of workers and monitoring by insurance agencies. This is the truly effective management tool. Therefore, we should simplify and diversify the forms of announcement of job search directly or online or in different ways so that unemployment benefit recipients can focus on spending time looking for jobs as soon as possible, contributing to creating value for society.
"If we insist on going directly to the public employment service organization where people are receiving unemployment benefits to notify them about job searches, we will create more difficulties for people receiving unemployment benefits," delegate Viet Nga emphasized.
Additional Government Responsibility for Unemployment Insurance
Concerning Article 31 of the Draft Law on Employment Services, National Assembly delegate Thach Phuoc Binh (Tra Vinh Provincial Delegation) proposed adding a content of employment services - that is, supporting training and improving skills for workers to the scope of employment services to suit the trend of developing a flexible labor market and the requirement of improving labor quality.
Regarding the unemployment insurance principle in Article 34 of the Draft Law, delegate Thach Phuoc Binh suggested emphasizing the application of technology in managing and resolving unemployment insurance regimes to help shorten the time for processing records and provide transparent information for workers.
National Assembly Delegate Nguyen Thi Thu Ha (Quang Ninh Province Delegation) proposed that the drafting agency consider adding a clause on the Government's responsibility for unemployment insurance. The delegate suggested that the Government issue a list and unit prices for public services using the unemployment insurance fund to ensure compliance with the overall program of State administrative reform for the 2021-2030 period.
Concern about the right to employment after restructuring
Clarifying some opinions of National Assembly deputies, Deputy Minister of Home Affairs Le Van Thanh stated that the regulation requiring workers to come directly to notify and search for jobs is to help workers receive job advice. The Ministry is studying the notification and search for jobs online, but in reality, there are cases of unemployment insurance beneficiaries still working outside - especially informal jobs, which are vulnerable to policy exploitation. "We continue to study how to control and avoid exploitation, but also create more favorable conditions for workers."
Speaking after the discussion on the afternoon of March 25, Vice Chairwoman of the National Assembly Nguyen Thi Thanh asked the Ministry of Home Affairs to pay attention to two contents when revising and completing the Draft Law to submit to the National Assembly for consideration and approval at the upcoming 9th Session.
Specifically, it is concerned with the content: developing vocational skills in the new era, the era of advancement of science, technology and artificial intelligence; developing occupations, vocational skills and the right to employment for those who follow the arrangement and streamlining of the organizational apparatus.
According to Vice Chairwoman of the National Assembly Nguyen Thi Thanh, the revised Law on Employment this time does not have many parameters and does not approach the issue of restructuring the apparatus. Previously, we only mentioned about more than 100 thousand people when streamlining the apparatus at the central level. Now we continue to streamline the apparatus at the provincial level and we do not have a district level, no agency has officially announced the number of people affected by this restructuring.
"We also request the Ministry of Home Affairs and comrades to approach more deeply and more about the content related to developing vocational skills and arranging general jobs for the subjects, in which we also pay attention and pay special attention to the subjects who retire after the arrangement" - Vice Chairman of the National Assembly stated.
In particular, Vice Chairwoman of the National Assembly Nguyen Thi Thanh suggested that in this Law on Employment, it is necessary to pay more attention to the issue of building a flexible employment model and mechanisms and policies to continue for those affected after the arrangement to leave the public sector to the private sector. "You also need to strengthen mechanisms and policies so that we can continue to promote the experiences as well as those who have been trained in the process of arranging the organizational apparatus" - Vice Chairwoman of the National Assembly expressed her opinion.
