Many violations discovered in a rural project

On April 16, according to documents collected by Thanh Nien reporters, during the inspection of the acceptance and settlement of the coastal road project in Trung Duong Service Area - Duc Loi Border Guard Station (in Duc Loi Commune, Mo Duc District, Quang Ngai), Quang Ngai Provincial Inspectorate discovered many violations.

The main reasons are that the People's Committee of the commune and the Management Board of the National Target Program (MTQG) of Duc Loi commune have loosened management of investment and construction; the Economic and Infrastructure Department of Mo Duc district lacks responsibility, does not detect violations to handle in determining construction costs according to regulations; the construction contractor, the design - estimate unit, and the construction supervision unit show signs of intentionally violating regulations, and have not strictly complied with regulations on investment and construction.

The coastal commune road project from Trung Duong Service Area to Duc Loi Border Guard Station, over 1.7 km long, is part of the National Target Program for New Rural Development of Quang Ngai Province, with a total investment of 3.8 billion VND. The investor is the Management Board for the National Target Program of Duc Loi Commune.

This project was surveyed and made an economic and technical report by Thien An Construction Consulting Company Limited, which was appraised by the Economic and Infrastructure Department of Mo Duc District. The Chairman of Duc Loi Commune People's Committee approved the economic and technical report on construction investment.

Cong Thanh Construction and Consulting Company Limited won the construction contract, Thanh Cong Construction and Trading Consulting Company Limited supervised the construction.

Construction started on March 28, 2019 and was completed on November 30, 2019.

Proposal to initiate criminal proceedings

According to the Quang Ngai Provincial Inspectorate, the implementation of the work of preparing the economic-technical report and project estimate of Thien An Construction Consulting Company Limited was irresponsible, leading to violations in determining construction costs, leading to an increase in the estimate of nearly 930 million VND.

The Economic and Infrastructure Department of Mo Duc District was irresponsible in appraising the budget, leading to errors that increased the budget by nearly 930 million VND. The responsibility lies with Mr. Pham Ngoc Tien, Head of the Economic and Infrastructure Department; Mr. Do Nhuan, former specialist of the Economic and Infrastructure Department, directly appraised.

The organization and implementation of the construction project by Cong Thanh Construction and Consulting Company Limited showed signs of intentionally violating regulations to appropriate nearly 986 million VND; the supervision of the project by Thanh Cong Construction and Trading Consulting Company Limited showed signs of intentionally violating regulations, leading to the appropriation of more than 31 million VND and causing a loss of nearly 986 million VND to the state budget.

The implementation of investment management and construction of the Duc Loi Commune National Target Program Management Board was lax in management, leading to payment and settlement violations, increasing the value of the project by more than 1 billion VND. The responsibility belongs to Mr. Le Minh Viet, Chairman of Duc Loi Commune People's Committee (Head of the Management Board) and Mr. Le Van Tien, Vice Chairman of Duc Loi Commune People's Committee (Deputy Head of the Management Board) and members of the Duc Loi Commune National Target Program Management Board.

The Chief Inspector of Quang Ngai province has issued a decision to recover and pay into the state budget more than 1 billion VND in violations.

Pursuant to the Law on Inspection 2022 and relevant legal provisions, considering the nature and extent of violations with signs of crime and implementing the direction of the Chairman of the People's Committee of Quang Ngai province, the Chief Inspector of Quang Ngai province proposed to prosecute and transfer the case file to the Investigation Police Agency of the Provincial Police to consider and prosecute the criminal case against the act of violating the management and use of public investment capital and construction works causing serious consequences as prescribed in Article 224 of the Penal Code 2015, amended and supplemented in 2017.
