Demand for trademark and patent registration is increasing

Continuing to question Minister of Science and Technology Huynh Thanh Dat, delegate Dinh Ngoc Quy (Gia Lai delegation) questioned the situation of processing applications for industrial use rights protection, which is very slow and prolonged.

In particular, for applications for trademark and industrial design registration, it greatly affects the rights of people and businesses, even leading to commercial disputes.

"The backlog of trademark and patent registration applications is huge. This is something the ministry is very concerned about," Minister Huynh Thanh Dat admitted.

The head of the Ministry of Science and Technology said that the reason is partly because in recent years, the economy has developed, so the demand for registering trademarks and patents has increased. In our country, this is still a new field, while other countries have been doing it for hundreds of years.

In addition, Mr. Dat said that investment in this field is still limited, and the procedures and processes for receiving, reviewing and processing documents are still slow. The slow application of information technology in document processing also causes delays in resolving requests.

"This backlog of documents is also causing difficulties for the ministry as the ministry's administrative reform index has been deducted points over the past years," said Mr. Dat.

The National Assembly Chairman requested to clarify the number of backlog cases. Mr. Dat said that as of December 31, 2022, there were about 64,000 trademark registration applications that were behind schedule, and tens of thousands of patent applications were also backlogged.

The fundamental solution proposed by Mr. Dat is to increase the application of information technology, digital transformation and adjust the application receiving and selection process to speed up the processing of documents.

"We are not subjective, but we also aim to overcome this limitation by 2025-2026," he said.

Vietnam's science and technology market develops slowly

Participating in the questioning session, delegate Tran Thi Hong Thanh (Ninh Binh delegation) asked: To develop the science and technology market from 2011 to present, the State management apparatus on science and technology has been improved from the central to local levels, and many related legal documents have been issued. The Government has also issued the National Science and Technology Market Development Program until 2030.

However, the Vietnamese science and technology (S&T) market is still limited. Could the Minister please tell us why the Vietnamese science and technology market has not yet developed? What fundamental solutions should be focused on in the coming time to develop the S&T market?

In addition, according to the report, the Ministry of Science and Technology assessed that most Vietnamese enterprises will be interested in investing in application, innovation, research and technology development, but the capacity to absorb and innovate technology is still very weak.

This is a major barrier to improving productivity, product quality, and competitiveness of enterprises. Could the Minister please tell us what mechanisms and policies are needed in the coming time to improve capacity, promote application, innovation in research and technology development of enterprises?

Responding to questions, Minister Huynh Thanh Dat said that policies and legal mechanisms for adjustment are already available, the important thing is how to apply and implement them in practice.

In recent times, the Ministry of Science and Technology has issued regulations and circulars to promote this activity. The results have been that many new and advanced technologies have been deployed in the fields of telecommunications, construction, and transportation.

Some industries have international competitiveness, deeply participate in the supply chain, production value, product value have competitive advantages. These results are the efforts of the leadership agencies from the Ministry of Science and Technology and enterprises.

However, the Minister said that in addition to the achievements, there are also difficulties and limitations, especially the mechanisms and policies have not really been promoted well, the connection activities and accompanying support services are not effective. Resources from the budget and from enterprises for this activity are still modest, infrastructure and technology are still limited, especially for advanced technologies.

In the coming time, the Ministry of Science and Technology will propose to the Government and the Prime Minister to adjust mechanisms and policies. The Ministry will also adjust regulations to suit reality.

"We will promote the program of searching, transferring, and mastering technology development from abroad to Vietnam. That is the most fundamental solution," said Minister Huynh Thanh Dat.

According to the Minister, these are measures and solutions proposed by the Ministry of Science and Technology to enhance the reception, transfer, mastery and development of technology to increase productivity, quality, efficiency and competitiveness of enterprises, contributing to the competitiveness of the economy .
