Speaking at the discussion on the Draft Law on Organization of Local Government (amended), National Assembly delegate Ha Sy Dong (National Assembly Delegation of Quang Tri Province) said that in practice, after amending the Law on Organization of Local Government in 2019, Da Nang City, Ho Chi Minh City and now Hai Phong City have been allowed by the National Assembly to implement one-level urban government and have shown to be very effective.
In the current conditions, we are implementing a revolution to streamline the organizational apparatus, so the local government organization also needs to be redesigned to suit the characteristics of urban and rural areas. This is not contrary to the Constitution.
Therefore, delegate Ha Sy Dong suggested that the drafting agency should study that while the local government organization in rural areas has not been innovated, it is necessary to strongly innovate the local government organization in urban areas to promote development.
Sharing the same view, National Assembly delegate Tran Quoc Tuan (National Assembly delegation of Tra Vinh province) said that while it is not possible to innovate the organization of local government in rural areas, it is necessary to strongly innovate the organization of local government in urban areas like other places that have been and are effectively piloting. Participating in the debate, National Assembly delegate Nguyen Phuong Thuy (National Assembly Delegation of Hanoi) said that the 2024 Capital Law as well as a number of resolutions stipulating specific mechanisms and policies for a number of localities have stipulated that superiors are allowed to adjust procedures when delegating authority to subordinates according to the provisions of the Law and Resolution.
Delegate Nguyen Phuong Thuy proposed that the draft Law clearly stipulate responsibilities and mechanisms for central state agencies to monitor and adjust procedures so that authorized agencies can effectively implement them.
Ensure the smooth operation of the government apparatus through streamlining and streamlining
In her explanatory speech, Minister of Home Affairs Pham Thi Thanh Tra said that the core and focus of the Draft Law on Organization of Local Government is to define, clarify, and perfect the decentralization, delegation of authority, and authorization to local governments to implement the motto "locality decides, locality does, locality takes responsibility". At the same time, it ensures immediate stability to operate the local government apparatus smoothly during the process of arranging and streamlining the organization and apparatus.
According to Minister of Home Affairs Pham Thi Thanh Tra, in the context that we are continuing to evaluate the overall organizational model of the entire political system, the Government proposes to keep the local government organizational model as in current law.
If it is not temporarily maintained, there will be a gap in the operation of the local government organization system and the local government model. For localities that are piloting urban government (not organizing district and ward People's Councils) according to the National Assembly's resolutions, it can still continue to be implemented without any problems.
“In addition, in the context of streamlining the organizational structure, the Ministry of Home Affairs is coordinating with the Central Organizing Committee to conduct a comprehensive assessment and study of the organizational structure model, including the local government system,” said Minister of Home Affairs Pham Thi Thanh Tra, hoping that National Assembly deputies will support the temporary plan to keep it as it is.
