On February 12, after the opening session of the 9th Extraordinary Session, the National Assembly held a group discussion on the draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly and the draft Law on Promulgation of Legal Documents (amended).
Giving opinions at the meeting on this content, the majority of delegates agreed to comprehensively amend the Law on Promulgation of Legal Documents in order to promptly institutionalize the Party's policy on innovation and improvement of the law-making process; contributing to accelerating the progress, improving the quality of development and promulgation of legal documents, and perfecting institutions to meet the requirements of national construction and development in the new period. The draft Law has basically followed and fully institutionalized the orientation of innovation and improvement of the law-making process according to Conclusion No. 119-KL/TW dated January 20, 2025 of the Politburo and the requirement of innovation in law-making thinking. In addition, opinions also suggested continuing to review to ensure the consistency of the legal system, especially with other draft laws considered and approved by the National Assembly at the same Session.
Speaking at the discussion, delegate Nguyen Xuan Thang, Politburo member, Director of the Ho Chi Minh National Academy of Politics, Chairman of the Central Theoretical Council, National Assembly delegate of Quang Ninh province, said that the comments to complete the draft law must ensure the goal that when the law is issued, it must be clear, easy to understand, easy to do, easy to organize, easy to deploy, easy to implement. The delegate suggested that for the regulations on consultation in the draft Law on Promulgation of Legal Documents (amended), a specific framework must be specified, whose opinions should be sought to make the law practical and feasible. The delegate also agreed with the law building in the direction of shortening the time for promulgating legal documents when there is a proposal from the Government.
Regarding the Law amending and supplementing a number of articles of the Law on the Organization of the National Assembly, the delegate said that it is necessary to fundamentally reform the functions of the National Assembly in promulgating laws. In addition, in arranging the organization of the apparatus, it is necessary to refer to the suitability over the periods. It is necessary to carefully consider the roles and positions of the job and to evaluate and summarize from practice to see the necessity for each position. The delegate also suggested that the law should more clearly define the roles of National Assembly deputies, especially full-time National Assembly deputies.
Delegate Vu Dai Thang, member of the Party Central Committee, Secretary of the Provincial Party Committee, National Assembly delegate of Quang Ninh province, said that the content of the draft laws must meet specific and precise requirements when using terms to ensure the sustainability and detail of the law. Regarding the Law on Promulgation of Legal Documents (amended), the delegate agreed with the direction of shortening the time to promulgate legal documents when there is a proposal from the Government. Regarding the draft Law on amending and supplementing a number of articles of the Law on Organization of the National Assembly, the delegate agreed with the content put forward in the draft law; especially in the context of streamlining the apparatus as it is now.
Commenting on the draft Law on Promulgation of Legal Documents (amended), delegate Pham Duc An, Chairman of the Provincial People's Committee, National Assembly delegate of Quang Ninh province, proposed that Article 53, Clause 3 stipulates that legal documents of the People's Council, People's Committee, local authorities, and special economic administrations should not be retroactively effective, and should not be rigidly regulated to ensure the requirements for implementing legal documents locally. The delegate also suggested considering the connectivity and system of legal documents to ensure their enforceability and practical implementation.
Also at the discussion, delegates Do Thi Lan, Vice Chairwoman of the National Assembly's Social Committee, National Assembly Delegate of Quang Ninh Province and delegate Tran Thi Kim Nhung, Standing Member of the National Assembly's Law Committee , National Assembly Delegate of Quang Ninh Province, focused on giving opinions on a number of key contents such as: Social criticism and policy consultation; policy making process; asking for opinions from competent authorities on major issues of draft legal documents...
