On July 27, Mr. Ho Ngoc Chanh, Vice Chairman of Phu My District People's Committee, Binh Dinh Province, said that he is directing the district's functional agencies to review the land origin map to have enough basis to handle violations of the illegal construction project of Mr. Ho Quoc Thanh (Xuan Thanh Nam village, My An commune).
"Currently, the Department of Natural Resources and Environment is reviewing the origin of the land that Mr. Thanh built on, the coastal corridor land and land under local management to have enough basis to handle land violations and avoid shortcomings," said Mr. Chanh.
Mr. Ho Quoc Thanh's illegal snail breeding pond was solidly built.
According to the reporter's investigation, land plot No. 28, cadastral map sheet No. 22, area of nearly 15,700m2 in Xuan Thanh Nam village (My An commune) is originally aquaculture land managed by the People's Committee of My An commune and land to protect the coastal corridor.
In 2006, Mr. Ho Quoc Thanh occupied land to build shrimp ponds and built a management house with an area of 87 square meters. In 2019, due to ineffective shrimp farming investment, he stopped operating.
In December 2023, Mr. Thanh renovated the site and built a project with an area of over 1,300m2, including 30 ponds with a volume of 9m3 and 32 ponds with a volume of 13.5m3. The ponds are built of bricks and plastered with cement to serve as a farm to produce and nurture snail seeds.
The People's Committee of My An commune has drawn up a record and requested Mr. Thanh to stop operating and voluntarily dismantle the violating construction before January 6, 2024. Mr. Thanh has signed a commitment to self-dismantle.
Mr. Thanh's illegal construction was built solidly on land managed by the People's Committee of My An commune and land protecting the coastal corridor.
However, on January 29, 2024, Mr. Thanh continued to complete the remaining lakes, not complying with the request of the People's Committee of My An Commune. The People's Committee of My An Commune invited Mr. Thanh to work and requested that they be dismantled before February 2, 2024.
On April 17, the inspection team of Phu My district coordinated with My An commune to inspect the construction site of Mr. Ho Quoc Thanh and discovered that the illegal construction site had increased to more than 1,400 square meters. Including the management house; the production and breeding house for snails and the water tank.
Thus, after many inspections and records by the People's Committee of My An commune, Mr. Ho Quoc Thanh's household also signed a commitment to dismantle the illegal construction, but not only was it not handled, but more construction was also built.
Mr. Thanh's illegally built snail pond has not yet been handled.
Regarding the delay in handling this illegal construction, Mr. Le Van Thuong - Chairman of the People's Committee of My An commune said that in the more than 1,400m2 of construction that Mr. Thanh built, it has not been determined how much of the area belongs to the coastal corridor protection land and how much of the land belongs to the management of the People's Committee of My An commune.
Therefore, the People's Committee of My An commune continued to send an official dispatch to the People's Committee of Phu My district requesting direction to the Department of Natural Resources and Environment, the Department of Justice, and the District Land Registration Office to guide the People's Committee of the commune in handling the matter.
According to Phu My District Inspectorate, Mr. Thanh’s illegal construction affected the land protecting the coastal corridor. The process of Mr. Thanh raising snails and discharging wastewater also affected the environment without being licensed and inspected.
In fact, the reporter recorded at Mr. Ho Quoc Thanh's project, there were many cages where snails had just been released. The representative of the person in charge of the project here said that they had just released snails about 20 days old.
Recently, land encroachment and illegal construction have become a "hot" issue in Binh Dinh province, and the provincial leaders have directed that it be resolutely handled.
On June 30, 2023, the Chairman of Binh Dinh Provincial People's Committee continued to issue a Plan to handle land encroachment and occupation in the province.
In particular, the Chairman of Binh Dinh Provincial People's Committee requested that local leaders must take responsibility if there is illegal construction in the area under their management.
In Phu My district, two commune People's Committee Chairmen were disciplined and lost their positions due to many violations related to land in the area.
Specifically, recently, the Chairman of Phu My District People's Committee signed a decision to discipline and dismiss Mr. Nguyen Huu Kien - Chairman of My Phong Commune People's Committee, term 2021-2026.
The reason is due to violations in performing assigned duties and responsibilities, allowing many violations in land management and use in My Phong commune to occur but not being detected and handled promptly.
In addition, Mr. Dang Van Hop - Chairman of the People's Committee of My Thanh commune, was also disciplined with a warning and transferred to a new assignment as a specialist officer of the Forest Protection Management Board, due to lax land management, leading to complicated encroachment and illegal construction.
