It is expected that on May 31, the People's Court of District 1 (HCMC) will reopen the first-instance trial of defendant Nguyen Xuan Huong Trang (30 years old, also known as Trang Nemo) and 3 accomplices prosecuted for the crime of "disturbing public order".
3 accomplices, including: Pham Quyen Quy, Nguyen Ngoc Khuong (both 23 years old), and Phan Hoang Nam (24 years old).
Trang Nemo and accomplices at the first instance trial in November 2022
Regarding the defendant Nguyen Phuoc Tuan (31 years old), on January 18, 2023, the defendant died at his residence. According to the forensic autopsy conclusion, the cause of death was bronchial asthma/synthetic drug use. Therefore, in March 2023, the Investigation Police Agency of District 1 Police suspended the investigation of the defendant Tuan.
According to the indictment, Trang Nemo and her accomplices were prosecuted under Clause 1, Article 318 of the Penal Code, with a fine of VND5-50 million, non-custodial reform for up to 2 years, or imprisonment from 3 months to 2 years. The defendants were all subject to preventive measures of being prohibited from leaving their place of residence.
The indictment stated that Trang is the owner of Trang Nemo store in Nguyen Cu Trinh Ward (District 1). Due to a conflict with Ms. Tran Nguyen Tra My in online sales business, Trang Nemo made an appointment to meet Ms. My at the store to resolve the matter.
On the afternoon of January 16, 2022, Ms. My, Ms. Pham Le Khanh, and Ms. Tran Thi Hoang Yen went to Trang Nemo store.
Here, Ms. My and Ms. Yen went into the store to meet Trang to apologize, while Ms. Khanh stood outside. The apology was livestreamed by Trang Nemo on social media.
According to the incident, when apologizing, there was an exchange of words between Trang Nemo and the other parties, then the conflict led to a fight and caused traffic congestion on Nguyen Trai street.
On November 16, 2022, District 1 People's Court opened the first instance trial of Trang Nemo and her accomplices.
Accordingly, the representative of the District 1 People's Procuracy proposed that the panel of judges sentence Trang Nemo, Pham Quyen Quy, and Nguyen Ngoc Khuong to 6-12 months in prison; and proposed that defendant Phan Hoang Nam be sentenced to 12-18 months in prison.
However, later, District 1 People's Court returned the case file for further investigation to clarify Ms. Pham Le Khanh's request for those who caused her injuries.
However, in the latest indictment (April 10, 2023), the District 1 People's Procuracy stated that for the act of intentionally causing 3% injury to Ms. Pham Le Khanh, because it was not determined who caused Ms. Khanh's injury, and whether the attack was outside or inside Trang Nemo's store, the District 1 Police issued a decision to administratively sanction Trang Nemo and those involved in the incident, which was well-founded.
