According to VietNamNet reporters, at the mini apartment building that caught fire on the night of September 12 in Khuong Ha, Khuong Dinh (Thanh Xuan district, Hanoi), there were many apartments that had been sold and some that were being rented. However, some neighbors around did not know who the owner of this apartment building was.
A resident said that the person who built the apartment building was someone from another place who bought land and built it 7-8 years ago and has sold out. The selling price ranges from several hundred million VND to over 1 billion VND per apartment, depending on the area.
Sharing with VietNamnet, Ms. H. in Kham Thien (Hanoi), a relative of the victims living in the mini apartment building, said that she has 7 relatives living in the apartment building where the fire broke out.
Among them, her sister and her husband, both over 60 years old, bought an apartment of about 35 square meters on the 8th floor of the house a few years ago.
"My niece, my sister's daughter, also rented an apartment on the 3rd floor because she wanted to live near her parents. Her family has 2 parents and 3 children," Ms. H. said. The family has now learned that 3 relatives have passed away, and 4 people are still waiting for news.
In this case, is the owner of the mini apartment building responsible?
Sharing with VietNamNet reporter, Lawyer Tran Tuan Anh, Director of Minh Bach Law Firm said that when there are particularly serious consequences, the investigation agency must get involved.
“Fire prevention and fighting violations are certain. With a house in a small alley, 9 floors high and with such a number of residents, it is very likely that the owner did not apply for a fire prevention and fighting permit according to the law.
Here, we also have to talk about the responsibility for construction. To clarify, the investigation agency needs to get involved to see if the house was built according to the permit? I am afraid that it was built without the permit. In there, no one granted a permit for a plot of land of about 200m2, built up to 9 floors, with 45 apartments," said Lawyer Tuan Anh.
Therefore, according to the lawyer, the homeowner still has to bear the main responsibility. Because if the homeowner had complied with the construction permit and fire prevention regulations, the unpredictable consequences like today would not have happened.
“To determine responsibility, an investigative agency needs to step in to clarify. Mini apartments are a common name for small apartments for rent or sale, with shared ownership. As for permission to build mini apartments, no agency has the authority to grant permission to build in the small alley of Khuong Ha.
The main responsibility still belongs to the owner who built those apartments, including responsibility for fire prevention and construction," Mr. Tuan Anh added.
According to the lawyer, the responsibility also lies with the management agency.
“If it had been done correctly, there would never have been a house like this in Thanh Xuan district. There was lax management in the construction work. It is necessary to consider who is responsible, and it is necessary to assign direct legal responsibility to individuals. This incident is the result of lax management by local authorities for a long time, regarding the type of apartments built for rent and sold under co-ownership. The buying and selling of these apartments is public, and no one manages them,” the lawyer emphasized.
According to lawyer Tuan Anh, if there were no lax management by agencies such as construction order management, local police, fire safety assessment and no disregard for profits by homeowners and investors, this consequence would not have happened.
"This is also a lesson and warning for similar housing areas," Mr. Tuan Anh added.
