The Ministry of Industry and Trade has just issued Circular No. 23/2024/TT-BCT dated November 7, 2024 regulating the management and use of industrial explosives and explosive precursors.
This Circular details a number of articles of the Law on Management and Use of Weapons, Explosives and Supporting Tools on the management and use of industrial explosives and explosive precursors under the management authority of the Ministry of Industry and Trade, including: List of industrial explosives, List of explosive precursors permitted for production, trading and use in Vietnam; authority to grant, re-grant, and adjust licenses and certificates on management and use of industrial explosives and explosive precursors; competent management agencies to issue documents requesting the granting of blasting service licenses on the continental shelf or with a scope of operation throughout the territory of the Socialist Republic of Vietnam; New registration dossiers and procedures, additional registration for research, development, testing, evaluation and recognition of registration results of explosive products in the research, development, testing, production phase or first import into Vietnam into the List of industrial explosives permitted to be produced, traded and used in Vietnam.
Assess safety risks, develop blasting plans, blasting passports, emergency response plans and periodic and ad hoc reporting regimes in the management and use of industrial explosives and explosive precursors; develop, manage, update and exploit databases on industrial explosives and explosive precursors for subjects under the management of the Ministry of Industry and Trade; application forms, licenses and certificates on the management and use of industrial explosives and explosive precursors; notification forms on the use of industrial explosives and notification of the implementation of blasting service activities.
According to the Ministry of Industry and Trade, the Circular applies to agencies, organizations, enterprises and individuals related to the management and use of industrial explosives and explosive precursors in Vietnam.
Regarding the implementation provisions, the Ministry of Industry and Trade said that this Circular takes effect from January 1, 2025. Circular No. 13/2018/TT-BCT dated June 15, 2018 of the Minister of Industry and Trade regulating the management and use of industrial explosives and explosive precursors used to produce industrial explosives is annulled; Circular No. 31/2020/TT-BCT dated November 30, 2020 of the Minister of Industry and Trade amending and supplementing a number of articles of Circular No. 13/2018/TT-BCT dated June 15, 2018 of the Minister of Industry and Trade regulating the management and use of industrial explosives and explosive precursors used to produce industrial explosives; Clause 1, Clause 2, Clause 3, Article 12 of Circular No. 42/2019/TT-BCT dated December 18, 2019 of the Minister of Industry and Trade amending and supplementing a number of regulations on periodic reporting regime in Circulars issued or jointly issued by the Minister of Industry and Trade.
The Circular clearly states that in case the legal documents cited in this Circular are amended, supplemented or replaced by new documents, the new documents shall be implemented. In the process of implementation, if any problems arise, agencies, organizations, enterprises and individuals shall promptly report to the Ministry of Industry and Trade for guidance or research to resolve.
