The Ministry of Public Security is seeking comments on a draft decree detailing a number of articles in the Law on Road Traffic Order and Safety (effective from January 1, 2025).

According to the Law on Road Traffic Order and Safety, commercial vehicles transporting preschool children and students "must have paint colors according to Government regulations".

To regulate the above issue in detail, in the draft, the Ministry of Public Security proposed that commercial vehicles transporting preschool children and students must be painted dark yellow on the outside of the vehicle. At the same time, the front and two sides of the vehicle above the windows must have signs identifying them as vehicles specifically used to transport preschool children and students.

For vehicles used for transportation combined with activities of transporting preschool children and students, the Ministry of Public Security proposes that there must be signs identifying that the vehicle is transporting preschool children and students placed on the front and two sides of the vehicle above the windows.

Regulations on paint colors and identification signs for vehicles carrying preschool children and students are expected to contribute to tightening this type of transportation business, especially after a series of incidents of leaving students on vehicles with heartbreaking consequences that have occurred recently.

It is noted that at many units providing student transportation services, school buses are often not specifically designed but are used in combination with transportation businesses (carrying tourists on weekends, for example) to maximize profits.

Expressing support for the Ministry of Public Security's proposal, a driver with extensive experience in transporting students said that the draft regulation would improve the quality of this service.

In particular, the draft clearly defines two cases, in which yellow paint is only required for vehicles used exclusively to transport students. For vehicles used to transport students and for business transportation, the draft stipulates that only a system of identification signs is required. This will facilitate units using vehicles for both types of services, avoiding rigidity.

Mr. Nguyen Van Quyen, Chairman of the Vietnam Automobile Transport Association, also agreed on the need to tighten management of student transportation activities.

However, he suggested that there should be a roadmap for implementation, especially the regulation that school buses must change their paint color. This regulation can be piloted first for preschool and primary schools, then summarized and expanded, thereby reducing pressure on businesses.

Install driver image recording device

The Law on Road Traffic Order and Safety also stipulates: passenger cars with 8 seats or more (excluding the driver's seat) used for transportation business, tractor-trailers, and ambulances must be equipped with journey monitoring devices and devices to record the driver's image.

To specify the above content, the Ministry of Public Security proposes that the installation of image recording equipment must ensure 3 requirements.

Firstly, record and store images of drivers while the vehicle is in traffic. Image data is provided to the police and licensing authorities, ensuring public and transparent supervision.

Vehicle image storage time is at least the last 24 hours for vehicles operating on routes up to 500 km; at least the last 72 hours for vehicles operating on routes over 500 km.

Second, images from the image recording device installed on the vehicle must be transmitted at a frequency of 12 to 20 times/hour (equivalent to 3 to 5 minutes/data transmission) to the transport business unit and stored for at least the last 72 hours.

Image data must be provided promptly, accurately, and without modification or falsification before, during, or after transmission.

Third, the image recording device must be kept operational to ensure continuous image recording and storage without interruption as prescribed.

In addition, transport business units, managers of tractor-trailers, ambulances, and traffic rescue vehicles must provide server access accounts to the Ministry of Public Security (Traffic Police Department), the Ministry of Transport (Vietnam Road Administration) to serve the management and handling of violations.
