Hai Duong Mr. Nguyen Van Xuan was fined 900 million VND for using an excavator and car to illegally exploit 65 cubic meters of sand in Binh Giang Lake.
The decision to administratively fine Mr. Xuan, 45 years old, in Pha Lai ward, Chi Linh city was issued by the Chairman of Hai Duong Provincial People's Committee at the end of March.
A month earlier, the authorities of Chi Linh City discovered Mr. Xuan mining sand in the Binh Giang Lake area. Due to not having a mining license, Mr. Xuan was fined 175 million VND, and all evidence and means of administrative violation, including nearly 65 cubic meters of sand, two excavators and a truck, were confiscated.
However, the two excavators and the truck belonged to someone else. The vehicle owner did not know about Mr. Xuan's violation, so the authorities returned the vehicle. Mr. Xuan therefore had to pay an amount equivalent to the value of the violating vehicle, nearly 702 million VND.
In addition, Mr. Xuan must restore the environment, bring the exploited area to a safe state and pay for the cost of appraisal and inspection of more than 26 million VND.
According to Decree 36/2020, if the total volume of illegally exploited minerals is 50 m3 or more, the fine is from 150 to 200 million VND. However, Mr. Xuan had to face many additional penalties, so the total fine is 4-5 times the above amount.
