A judge this month rejected Musk’s request to halt the artificial intelligence group’s transition to a for-profit model, but agreed to push the trial to the fall, the latest twist in the bitter legal battle.
“We welcome the court’s decision on March 4, rejecting Elon Musk’s latest attempt to slow down OpenAI for his own personal gain,” OpenAI wrote in a blog post on Friday.
Billionaire Elon Musk co-founded OpenAI with Altman in 2015 but left before the company became popular and then founded rival startup xAI in 2023.
Last year, the Tesla CEO and owner of social media platform X sued OpenAI and Altman, accusing OpenAI of straying from its original mission — developing AI for the benefit of humanity, not for corporate profit.
OpenAI and Altman have denied the allegations, while Altman has suggested that billionaire Musk is trying to slow down a competitor.
At the heart of the lawsuit is ChatGPT's transition to a for-profit model, which the startup says is crucial to raising more capital and competing well in the costly AI race.
OpenAI’s last funding round, worth $6.6 billion, and a new round of up to $40 billion in discussions with SoftBank Group are both contingent on OpenAI restructuring to remove control from the nonprofit.
Friday's filing comes weeks after Altman, who has said OpenAI is not for sale, turned down an unsolicited $97.4 billion acquisition offer from a consortium led by billionaire Musk with a "No, thanks!"
