Ho Chi Minh City allows construction on agricultural land

(Dan Tri) - To build a project on agricultural land, Ho Chi Minh City requires that this land plot has been granted a certificate, is still valid, and has an area of ​​500m2 or more.


Ho Chi Minh City People's Committee has just issued Decision No. 90 on regulations on using an area of ​​agricultural land to build works directly serving agricultural production in the city.

Construction works directly serving agricultural production on agricultural land include sheds, camps, warehouses for preliminary processing, preserving agricultural products, storing agricultural materials, machinery, and labor tools.

The subjects of application are State agencies assigned to perform the task of State management of land and other relevant agencies, organizations and individuals; agricultural land users in Ho Chi Minh City.

The applicable condition is that the agricultural land plot has been granted a land use right certificate and is still valid. The agricultural land area of ​​the land in use is from 500m2 or more, including one or more adjacent land plots of one user.

The land area ratio for construction of works directly serving agricultural production is maximum 1% of the total agricultural land area but not exceeding 50m2. The works can only be built with 1 floor, maximum roof height of 5m, no basement, semi-permanent structure (brick wall or light material wall; brick column or steel column, iron column; light material roof).

Construction of works directly serving agricultural production must not affect irrigation works, dike works, adjacent agricultural land areas and must not violate existing road boundaries according to the planning approved by competent authorities.

In addition, the investor must unconditionally comply with the demolition and will not be compensated when the prescribed existence period expires or in case the competent State agency requests it as prescribed or until the agricultural land plot is approved by the competent State agency to change its land use purpose...
