Ho Chi Minh City handles administrative violations against 24 projects with delayed issuance of pink books

This is the information provided by a representative of the Department of Natural Resources and Environment of Ho Chi Minh City at a socio-economic press conference held on the afternoon of April 11. Specifically, there are currently more than 30,061 applications eligible for certificates, but investors and home buyers have not yet submitted their applications.

Although the city's land registration office has sent a dispatch to project investors and apartment management boards to urgently submit documents for certificates, and to the People's Committees of districts, Thu Duc City and project units for coordination, since then, investors have only submitted 9,278/30,061 documents.

Explaining the reason for the delay in granting certificates, the Department of Natural Resources and Environment of Ho Chi Minh City said that problems related to the implementation of additional financial obligations due to changes in planning adjustments led to the delay in granting certificates.

“Because some projects have had detailed planning at 1/500 scale for a long time, the project scale and planning criteria are no longer suitable for social development, so the investor has proposed to change and adjust the planning and scale of the project, which may give rise to additional financial obligations,” said a representative of the Department of Natural Resources and Environment.

On the afternoon of April 11, the City Party Committee's Propaganda Department coordinated with the Department of Information and Communications of Ho Chi Minh City to hold a press conference to provide information on socio-economic issues in the area.

Since then, the Department of Natural Resources and Environment of Ho Chi Minh City has coordinated with relevant departments and investors to accelerate the determination of additional financial obligations. At the same time, it has advised the Ho Chi Minh City People's Committee to issue Notice No. 559/TB-VP dated July 22, 2023 on determining cases where planning indicators are changed without increasing the land use coefficient, which are determined to not be subject to additional financial obligations.

Regarding mortgaged projects, the investor has mortgaged the land use rights at credit institutions, the representative of the Department of Natural Resources and Environment informed: "Before carrying out the procedure of granting certificates to home buyers, the investor has not yet released the mortgage on the land use rights to submit the original land use rights certificate of the project to the Department to adjust the conversion of the land use form to the form of shared use".

Typically, Khang Gia apartment building (Go Vap district); Duc Khai apartment building (District 7); 4S Linh Dong apartment building (Thu Duc city) made people very upset when they have not been granted certificates, while in fact the investor has not yet cleared the mortgage.

Therefore, the Department of Natural Resources and Environment requests the Department of Construction of Ho Chi Minh City to update information on which projects have signed contracts with customers, which projects have documents announcing eligible housing from the Department of Construction so that the Department of Natural Resources and Environment can review and synthesize reports to the People's Committee of Ho Chi Minh City.

"In addition to protecting the rights of home buyers in housing projects, when issuing certificates, it is necessary to ensure compliance with legal regulations. Therefore, for projects that are eligible for certificates, investors are requested to promptly submit documents to issue certificates to home buyers," a representative of the Department of Natural Resources and Environment noted.

In addition, according to Decree 91/2019/ND-CP, investors who delay in completing documents for granting pink books can be fined up to 1 billion VND. Since Decree 91 took effect (January 5, 2020), the Inspectorate of the Department of Natural Resources and Environment of Ho Chi Minh City has reviewed and proposed competent authorities to issue decisions to handle administrative violations against 21 projects, with a budget collection of more than 7.7 billion VND.

In addition, the Department has also prepared a record of penalties and is submitting it to the competent authority to issue a decision to handle administrative violations against 3 projects. Thus, up to now, a total of 24 projects have been handled for administrative violations.
