On July 15, the Supreme People's Procuracy served the indictment on the case of Truong My Lan and accomplices phase 2 on the defendants in the case.
According to the indictment, 34 defendants were prosecuted for three crimes: "Fraudulent appropriation of property", "Money laundering" and "Illegal transportation of currency across borders".
In particular, Chairwoman of the Board of Directors of Van Thinh Phat Group (VTP) Truong My Lan was prosecuted for the crimes of "Fraudulent appropriation of property", "Money laundering" and "Illegal transportation of currency across the border".
The indictment determined that from 2018 to 2020, Truong My Lan proposed and directed the use of 4 companies: An Dong, Sunny World, Quang Thuan and Setra to issue more than 308 million bonds to mobilize capital from 35,824 investors, earning more than 30,000 billion VND. This amount of money was not issued for the right purpose, leading to the inability to pay the bond debt. Accomplices are the defendants: Dinh Van Thanh (former Chairman of the Board of Directors of SCB); Vo Tan Hoang Van (former General Director of SCB); Nguyen Phuong Hong (Deputy General Director of SCB, deceased); Nguyen Tien Thanh (Chairman, General Director of TVSI Securities Joint Stock Company, deceased) and Ho Buu Phuong (Deputy General Director of VTP Group).
In the crime of "Money Laundering", Truong My Lan and 8 others were prosecuted for appropriating a total amount of hundreds of thousands of billions of VND through "embezzlement of assets" and fraudulent bond issuance, then using tricks to launder money. In particular, defendant Truong My Lan directed her accomplices to withdraw money, transfer money out of the SCB system and spend it for various purposes; transfer money abroad to pay for fake contracts.
Regarding the crime of "Illegal transportation of currency across the border", the indictment clearly stated that the defendant Truong My Lan and 8 defendants illegally transported more than 4.5 billion USD (equivalent to more than 106,000 billion VND). Truong My Lan and her accomplices established fake contracts to buy and sell shares and capital contributions; through these contracts, money was transferred from abroad to Vietnam and from Vietnam to abroad.
Notably, the indictment stated that the case showed loopholes and shortcomings in a number of legal documents and in state management of the fields of securities, finance, and banking (foreign exchange management, anti-money laundering, credit)... These were the causes and conditions leading to the defendants' criminal acts.
The State Securities Commission, the Anti-Money Laundering Department under the Banking Inspection and Supervision Agency, the State Bank, and the Foreign Exchange Management Department under the State Bank failed to promptly detect violations by VTP Group and companies under VTP Group for timely handling.
The People's Procuracy will recommend the completion of legal regulations that are still lacking or have loopholes; recommend relevant agencies to have institutions, policies, and solutions to overcome and prevent violations and crimes.
On April 11, the Ho Chi Minh City People's Court sentenced 86 defendants in the case of Truong My Lan and her accomplices in phase 1. Defendant Truong My Lan was sentenced to death for "embezzlement of property", 20 years in prison for "bribery", and 20 years in prison for "violating regulations on lending in the activities of credit institutions". The total sentence is death.
The panel of judges ordered defendant Truong My Lan to fully compensate for the damage of 1,243 outstanding loans at SCB, deducting the amount the defendants had paid back, forcing the defendant to compensate more than 673,000 billion VND.
After the first instance trial, Truong My Lan filed an appeal against the entire verdict.
