On the morning of November 9, continuing the eighth session, under the chairmanship of Vice Chairman of the National Assembly Nguyen Khac Dinh, the National Assembly discussed in the hall the draft resolution of the National Assembly on piloting the handling of evidence and assets during the investigation, prosecution and trial of a number of criminal cases.

Participating in the discussion, the majority of National Assembly deputies agreed to issue a Resolution on piloting a number of measures to handle evidence and assets in criminal proceedings in order to contribute to improving the effectiveness of the fight against crime, especially economic and corruption crimes, better ensuring the rights and legitimate interests of relevant organizations and individuals, as well as minimizing negative impacts on the investment and business environment. The pilot results will create a practical basis for perfecting the law on criminal and criminal proceedings in the coming time.
Delegate Tran Khanh Thu, National Assembly Delegation of Thai Binh province, stated that in reality, there are big cases that usually last for years. When the investigation agency temporarily detains, seizes and prohibits transactions, when the case is resolved, there are assets that should have been handled or handled early during the investigation, prosecution and trial, but they cannot be handled until the court tries them, causing waste and these assets cannot be put into use. There are assets that the defendant, the accused, and the victim still want to handle. Even if the defendant wants to pay money or pay assets to remedy the consequences to make it a mitigating circumstance, they must go to court. At that time, the value of the assets cannot be properly assessed, or the assets may be damaged, degraded and unusable.
Therefore, it is extremely necessary to draft a Resolution to promptly resolve issues arising in practice, create a legal basis for application, consider and promptly handle evidence and assets in cases and cases under the supervision and direction of the Central Steering Committee on Anti-Corruption and Anti-Negative Practices, ensuring effectiveness, compliance with the law, avoiding loss, waste, violations, corruption, negativity, ensuring the legitimate interests of the State, the rights and legitimate interests of organizations and individuals. The delegate also requested the drafting committee to review and clarify the scope of adjustment to suit practice and avoid conflicts with relevant current laws and codes. The delegate said that measures to handle evidence and assets during the litigation process are the most basic core content of the resolution and are shown in Article 3, which stipulates 5 groups of policies and 5 groups of handling measures; Therefore, it is recommended to define more clearly the criteria and conditions for applying the measure of depositing money to recover assets;...
Next, the National Assembly deputies discussed in groups the draft Law on Teachers and the draft Law on Employment (amended).
Participating in the discussion, National Assembly deputies agreed with the necessity of promulgating the Law on Teachers to institutionalize the Party's policies and viewpoints and the State's laws on the position and role of teachers, creating a legal basis for adjusting the regime and policies for teachers as well as creating conditions for teachers to develop in both quantity and quality, meeting the requirements of national development in the new situation. In particular, ensuring consistency in the Party's viewpoints and policies that "education and training are the top national policy". In addition, deputies also participated in a number of specific contents such as the legal status of non-public teachers, clearly defining the rights and responsibilities of foreign teachers, recruiting and using teachers, policies related to attracting teachers, etc.
Draft Law on Employment, delegates agreed on the need to amend the Law to remove difficulties and obstacles caused by the provisions of the current Law, creating a solid legal corridor for the construction and synchronous development of labor market factors, contributing to the positive shift in labor structure. Delegates proposed to study, review and clearly define the scope of regulation to ensure consistency and unity in the legal system between the draft Law on Employment (amended) and related laws such as the Labor Code, Law on Social Insurance, Law on Vietnamese Workers Working Abroad under Contracts... Review the compatibility of provisions of the draft Law with the implementation of international commitments and international treaties in the field of labor and employment.
