The Ministry of Public Security has issued Circular No. 17/2024/TT-BCA detailing a number of articles and measures to implement the Law on Identification; effective from July 1, 2024.
This Circular provides details and implementation measures on the form of electronic identification; the content shown on the identification card for information on place of residence; the content shown on the identification card in cases where there is no or incomplete information on place of birth, place of birth registration, hometown, ethnicity, religion; organization of receiving applications for issuance, exchange, re-issuance of mobile identification cards when necessary; agreement on using national identification applications; forms used in issuing and managing identification cards; forms used in collecting, updating, adjusting, integrating, confirming, exploiting information in the National Population Database, Identification Database; responsibilities of the Public Security of units and localities in the work of issuing and managing identification cards.
Applicable to Police of units and localities; Officers, non-commissioned officers, soldiers of the People's Police; Agencies, organizations and individuals related to the work of issuing and managing identification cards.
Form of electronic identity
According to the Circular, electronic identification is represented in the form of an image of a valid ID card or citizen identification card and other information stored and integrated into the electronic identification is represented in the form of characters. The electronic identification is created by the identification management agency of the Ministry of Public Security with a separate symbol to authenticate and ensure accuracy and integrity in accordance with the provisions of the law on electronic transactions.
Electronic identification cards are accessed and used through electronic identification accounts on the national identification application; information related to the issuance, management, and integration of information on the identification card is fully and promptly updated.
Regarding the content shown on the ID card regarding information about place of residence, the Circular stipulates as follows: The information about place of residence shown on the ID card is the information about the permanent residence of the person issued the ID card.
In case the person requesting the issuance, exchange or re-issuance of an identity card does not have a permanent residence but has a temporary residence, the information about the place of residence shown on the identity card is the information about the temporary residence of the person to whom the card is issued.
In case the person requesting the issuance, exchange or re-issuance of an identity card does not have a permanent or temporary residence due to not meeting the conditions for permanent or temporary residence registration, the residence information shown on the identity card is the current residence information of the person being issued the card.
In case the person requesting the issuance, exchange or re-issuance of an ID card does not have information about the place of residence in the National Population Database, the ID management agency is responsible for guiding the citizen to carry out the procedures for permanent residence registration, temporary residence registration or declaration of information about residence. For Vietnamese citizens residing abroad who do not have a place of residence in Vietnam, the information about the place of residence on the ID card shall show the address of residence abroad (clearly transcribed in Vietnamese).
In addition, the Circular also stipulates the content shown on the ID card in cases where there is no or incomplete information about place of birth, place of birth registration, hometown, ethnicity, and religion.
National Identification Application Usage Agreement
Agencies, organizations, and individuals using the national identification application are responsible for: Providing complete and accurate data about the agency, organization, or individual when agreeing to use the national identification application. Not using electronic identification accounts or electronic identification cards for activities or transactions that are contrary to the provisions of law, infringing upon security, national defense, national interests, public interests, and the legitimate rights and interests of other agencies, organizations, and individuals. Not illegally interfering with the operation of the national identification application. Comply with the instructions for using the national identification application issued by the identification management agency of the Ministry of Public Security.
For the identification management agency of the Ministry of Public Security, it is responsible for: Applying security measures, ensuring information security and safety, protecting data provided by agencies, organizations and individuals during the development and management of the national identification application according to the provisions of law. Only using data provided by agencies, organizations and individuals when using the national identification application in accordance with the scope, purpose, functions and assigned tasks. Notifying agencies, organizations and individuals using the national identification application about activities related to their data processing, unless otherwise provided by law.
