(TN&MT) - On February 7, Dong Nai Provincial Party Committee held a conference to unify solutions to ensure construction materials for the construction of key national transport projects in the province. Member of the Party Central Committee, Minister of Natural Resources and Environment (TN&MT) Do Duc Duy and Secretary of the Provincial Party Committee Vu Hong Van chaired the conference.


Attending the Conference, on the side of central agencies, there was the participation of Deputy Minister of Transport Le Anh Tuan; Leaders of specialized units of the Ministry of Public Security, Ministry of Natural Resources and Environment, Ministry of Transport, and Government Inspectorate.

On the side of Dong Nai province, there were Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People's Committee Vo Tan Duc; Vice Chairman of the Provincial People's Committee Duong Minh Vu; leaders of departments, branches and localities of Dong Nai; investors in the construction of key traffic works in the province.

This leads to a huge demand for construction materials, especially filling materials and common construction materials. However, the supply capacity of mining enterprises and construction companies has not met the demand, due to many different reasons. Among them, there is an imbalance between the demand of projects and the supply capacity of mining enterprises; mining enterprises and mine owners face many difficulties in granting mining licenses and implementing activities due to subjective and objective reasons...

At the Conference, the Ministry of Natural Resources and Environment coordinated with Dong Nai province and related ministries and branches to support contractors and mining enterprises to resolve difficulties and ensure project progress.

Minister Do Duc Duy said that the parties need to frankly identify the main difficulties and obstacles in providing construction materials for key transport projects, and at the same time propose specific solutions and responsibilities of the parties involved. Management agencies and businesses need to coordinate closely to resolve problems and ensure project progress.

Proposal to support accelerating mineral exploitation for transportation projects

Reporting at the Conference, Director of the Department of Natural Resources and Environment of Dong Nai province, Mr. Dang Minh Duc, said that the locality is currently implementing three important traffic projects with large demand for construction materials. These projects require 5.167 million m3 of construction stone, 5.810 million m3 of fill soil and 1.468 million m3 of sand.

Accordingly, Dong Nai currently has 32 construction stone quarries licensed for exploitation by the Provincial People's Committee, of which 26 are operating, 05 have expired licenses and are waiting for renewal, 01 has been licensed but has not yet been exploited. The remaining stone reserves as of December 31, 2024 are 265 million m3, with an exploitation capacity of 22 million m3/year.

However, mining activities are facing difficulties in legal procedures. Of the 32 licensed mines, 26 mines are facing difficulties related to the issuance, extension and adjustment of Investment Registration Certificates. In addition, some mines have overlaps between construction planning and mining duration according to the license.

Faced with these challenges, Dong Nai proposed not to organize inspections and checks of stone and soil exploitation enterprises in the coming time to ensure the progress of material supply for important projects.

Dong Nai also requested the Ministry of Natural Resources and Environment to guide the extension of mining licenses for 5 expired mines. In addition, the Department of Natural Resources and Environment also proposed handing over the Nui Nua 3 stone mine (Dong Nai) to the national project contractor to speed up the progress of mining and infrastructure development.

Currently, the Southern region is implementing 15 key transport projects, leading to a sudden increase in demand for construction materials. Regarding this issue, Deputy Minister of Transport Le Anh Tuan said that there is currently a shortage of 11.756 million m3 of rock and 4 million m3 of fill soil for projects such as the Bien Hoa - Vung Tau expressway.

The main difficulties are related to licensing procedures, site clearance and land. The Ministry of Transport proposed that Dong Nai synthesize information about mines, assess supply sources, classify difficulties and speed up the licensing process. At the same time, adjust exploitation at some key mines to ensure timely supply.

In addition, the Provincial People's Committee was also proposed to allow contractors to temporarily gather unsuitable materials at the Amata Industrial Park and find more suitable dumping sites. These solutions are expected to help remove obstacles and ensure project progress.

Participating in the discussion at the Conference, representatives of contractors, construction material exploitation enterprises, and functional agencies also proposed a number of solutions to overcome current difficulties, including a proposal to increase exploitation capacity, currently, exploitation capacity is about 16-17 million m3/year, which can be increased by 50% to reach 25 million m3/year; Increasing the depth of exploitation, this adjustment will help increase exploitation reserves and restore suspended mines to help increase material supply.

In addition, it is proposed to establish a legal procedure settlement team with the participation of the Ministry of Natural Resources and Environment to ensure rapid processing progress; in the issue of rapid exploitation licensing, it is necessary to include Long Thanh airport and Ring Road 3 in the list of projects enjoying special mechanisms. In addition to the scarcity of materials, contractors also face obstacles in transportation. On average, the Long Thanh airport project needs 24,000m3 of materials per day, equivalent to 1,000 vehicles. It is proposed to support better transportation and at the same time have solutions to protect the environment...

Removing obstacles in exploitation and supply of construction materials

Concluding the Conference, Minister Do Duc Duy said that the opinions exchanged and discussed focused on resolving difficulties and obstacles in the supply of construction materials, especially stone, sand, and fill soil, for key projects in Dong Nai province, such as the Long Thanh airport project... The authorities are also always urgently looking for synchronous solutions to ensure the progress of important projects.

However, regarding the group of construction material supply for current projects facing many challenges, Minister Do Duc Duy pointed out that this is due to the lack of initiative from both the demand and supply sides. Investors and contractors have not clearly defined the needs in terms of type, quantity, quality requirements, and supply progress. Meanwhile, mineral enterprises have not been guided and coordinated to have timely preparation, so it is necessary to solve the current problem of balancing supply and demand.

Regarding immediate solutions, Minister Do Duc Duy suggested that current needs must be clearly identified, so investors need to make a specific list of materials, volume and quality requirements. To determine supply capacity, mineral exploitation enterprises need to plan exploitation based on current licenses and expansion capabilities.

On that basis, there needs to be a role for state agencies to regulate supply and demand, in which the Provincial People's Committee, the Department of Natural Resources and Environment and relevant agencies must work with investors and contractors to determine demand, and at the same time work with mineral enterprises to orient supply.

With the current administrative procedures, the Provincial People's Committee is requested to shorten the time for granting and extending mineral licenses to 15-20 days. Provide maximum support for procedures related to land, investment, and planning so that mineral enterprises can quickly put mines into operation. The Minister said these issues are all within the authority of the locality.

In addition, it is recommended that localities strictly manage material prices, requiring mineral enterprises to declare correct prices and sell at announced prices, and not to arbitrarily increase selling prices to contractors. In addition, state agencies (Provincial People's Committee, Department of Finance, Department of Construction) need to strictly manage the declaration and sale of material prices.

Minister Do Duc Duy noted the need to strengthen inspections and checks to ensure compliance with regulations on minerals, environmental protection, and to avoid illegal exploitation. With synchronous and drastic solutions, the Minister hopes that the problem of supply and demand of construction materials will soon be resolved, ensuring the progress of important projects in the coming time.

Solving the problem of landfill materials

Regarding recommendations to remove administrative obstacles regarding landfill materials, Minister Do Duc Duy said that currently, according to Decree No. 10 and Decree 11/2025/ND-CP detailing a number of articles of the Law on Geology and Minerals on the exploitation of Group IV minerals as well as guiding circulars, the procedures for exploiting landfill materials have been simplified with four main removal contents according to the "four no's" viewpoint, which are: No need for exploration; Not necessarily in accordance with planning; No need to establish an investment project to request investment policy; No need to prepare an environmental impact assessment report or apply for an environmental license.

Pointing out to the locality as well as contractors and enterprises carrying out exploitation and use, Minister Do Duc Duy informed that currently, for key projects, the process of exploiting landfill materials only requires: Surveying to determine reserves; Preparing registration documents and applying for a management license (instead of having a previous confirmation). The maximum licensing time is 10-15 days.

Regarding the resolution of land procedure problems for group 4 minerals, the Minister proposed that the land management units of the Ministry establish a working group to coordinate with the Department of Natural Resources and Environment to work with mine owners to review procedures and propose quick solutions according to models that some northern mountainous localities have implemented well, such as: No need to reclaim land if an agreement is reached with the people; The soil cover is peeled off and left behind, and will be restored after mining is completed; The land still belongs to the people, only compensation for crops on the land...

Applying the Law on Geology and Minerals 2024 to the use of stone as a common construction material

Minister Do Duc Duy suggested that management agencies and businesses need to coordinate closely to resolve problems and ensure project progress.

According to the locality's difficult proposal regarding the mines that have expired and 26/32 mines stuck in extension procedures, Minister Do Duc Duy said that currently, the Law on Geology and Minerals 2024 allows for extension if there are still reserves and the enterprise has a need. And this provision takes effect from January 15, 2025, the authority to extend is entirely under the Provincial People's Committee. If the application is submitted before January 15, 2025 according to the old law, the province will be resolved immediately, without having to wait for new instructions.

For the 26 licensed mines that are stuck in procedures, the Minister said that the extension of investment licenses is under the authority of the Department of Planning and Investment. Therefore, if the enterprise has a legitimate reason (such as the COVID-19 pandemic, site clearance problems, urgent needs of the central and local governments), the province can proactively adjust the investment policy decision. This content can be quickly implemented within 1 week.

Regarding the mechanism for granting quarries to contractors, if it is determined that they will be provided for key projects, the provincial people's council has the right to decide to appoint contractors, skipping the auction step to ensure project progress. The method of calculating the mining rights fee will be based on the average price of previously auctioned quarries. For the issue of contractors not having enough mining capacity, they can cooperate with specialized mineral mining enterprises to implement.

In order to focus on removing procedural barriers, price management and supply-demand coordination to ensure adequate supply of materials for key projects as soon as possible. Minister Do Duc Duy requested Dong Nai to have results of balancing supply and demand based on current licenses within 7-10 days. At the same time, establish an interdisciplinary working group headed by the Vice Chairman of the Provincial People's Committee to remove procedural obstacles. In addition, encourage mineral enterprises and contractors to directly transact with each other on prices and transportation, with the participation of state agencies for support.

The Minister also suggested that the Government Inspectorate consider postponing the inspection until the third and fourth quarters so that businesses can focus on completing procedures to meet the goals of completing key projects. The Minister also noted that the policy of comprehensive inspection of geology and minerals nationwide is still being implemented under the direction of the Prime Minister. However, the scope, time and level of implementation need to be considered to avoid putting pressure on businesses. The fact that businesses have to serve the inspection team, complete legal procedures and coordinate materials can affect the progress of the project.
