(TN&MT) - On the afternoon of February 12, examining the draft Law on Organization of Local Government (amended), Chairman of the Law Committee Hoang Thanh Tung agreed with the necessity of amending the scope, name and structure of the draft Law to fully institutionalize the Party's guiding viewpoints and the provisions of the 2013 Constitution on promoting decentralization and delegation, creating initiative for local governments according to the principle of "locality decides, locality does, locality is responsible", thereby improving the efficiency, effectiveness and efficiency of local governments at all levels.


Regulations in the direction of expanding the tasks and separate authority of the Chairman of the People's Committee

Briefly presenting the Proposal for the Law on Organization of Local Government (amended), Minister of Home Affairs Pham Thi Thanh Tra said that the draft Law consists of 7 chapters and 50 articles, 93 articles less than the current Law, with the following basic contents: on the division of authority, decentralization, delegation of authority between local governments at all levels; on the tasks and powers of local governments at all levels; on the model of local government organization; the organizational structure and operation of People's Councils and People's Committees at all levels; on the organization of administrative units, establishment, dissolution, merger, division, and adjustment of administrative unit boundaries.

Regarding the tasks and powers of local authorities at all levels, the Minister of Home Affairs said that, implementing the principle of "clear people, clear work, clear responsibilities" and avoiding overlapping regulations and duplication of tasks and powers between local authorities and between local government agencies, the draft Law specifically stipulates the tasks and powers of the People's Council and the People's Committee at each administrative unit in the direction of: defining tasks and powers between the People's Council and the People's Committee; defining tasks and powers of the People's Committee collective and the individual Chairman of the People's Committee where the local authority is organized in the direction of increasing tasks, powers and responsibilities for the individual Chairman of the People's Committee.

Regarding the organizational structure and operation of People's Councils and People's Committees at all levels, the Minister of Home Affairs stated that in order to ensure the streamlining of the organizational apparatus, improve the operational efficiency of People's Councils and People's Committees; increase the autonomy and self-responsibility of local authorities, the draft Law stipulates in the following direction:

For the People's Council, the draft Law stipulates the principles for determining the number of People's Council deputies based on population size, regional characteristics and socio-economic conditions of each locality; assigns the National Assembly Standing Committee to stipulate the number of People's Council deputies, the framework for the number of full-time People's Council deputies, the framework for the number of People's Council Committees; assigns the authority to the People's Council to decide on the establishment of Committees and decide on the number of full-time People's Council deputies to ensure compliance with local realities; assigns the Standing Committee of the People's Council to decide on measures to resolve unexpected and urgent tasks in preventing, combating and overcoming the consequences of natural disasters, epidemics, national defense, security, order and social safety; adjusts the budget estimate, allocates increased revenue, saves annual budget expenditures and reports to the People's Council at the nearest session; amends and supplements regulations on the activities of the People's Council to suit practical requirements.

Regarding the People's Committee, the draft Law basically inherits the provisions on the organizational structure of the People's Committee according to the provisions of the current Law and assigns the Government to stipulate the framework for the number of Vice Chairmen of the People's Committee at all levels, the number of specialized agencies under the People's Committee at the provincial and district levels; the People's Committee at the local government level operates under a collective regime combined with the individual responsibilities of the Chairman of the People's Committee and each member of the People's Committee; clearly stipulates the tasks of the People's Committee that must be discussed and decided collectively; the tasks and powers of the People's Committee are authorized to be performed by the Chairman of the People's Committee; stipulates in the direction of expanding the tasks and powers of the Chairman of the People's Committee.

Ensuring consistency, unity and transparency in the legal system on decentralization and delegation of authority

Examining this content, Chairman of the Law Committee Hoang Thanh Tung said that the Law Committee agrees with the necessity of amending the scope, name and structure of the draft Law on Organization of Local Government (amended) for the reasons as stated in the Government's Submission.

The content of the draft Law ensures that it is consistent with the Party's policies and guidelines. The draft Law dossier has been carefully and seriously prepared in accordance with the provisions of the Law on Promulgation of Legal Documents, and is qualified to be submitted to the National Assembly for consideration and decision.

Regarding the division of authority, decentralization, delegation, and authorization between local authorities at all levels (Chapter III), the Chairman of the Law Committee said that the Law Committee agrees with continuing to perfect regulations on decentralization and delegation to local authorities in order to concretize the policy of promoting decentralization and delegation, promoting the proactiveness, creativity, and self-responsibility of local authorities at all levels in the spirit of "locality decides, locality does, locality is responsible".

To continue to improve the regulations on the principles of decentralization, delegation, delegation, and authorization, it is recommended to continue reviewing to ensure consistency between the provisions of the draft Law and relevant provisions in the draft Law on Organization of the Government (amended) on how to regulate the principles of decentralization, delegation, delegation, and authorization, as well as ensuring consistency and transparency in terms of the subjects of decentralization and authorization, the objects receiving decentralization and authorization, and the methods and conditions for ensuring implementation.
