(TN&MT) - Continuing the program of the 9th Extraordinary Session, on the morning of February 12, the National Assembly discussed in groups the draft Law on amending and supplementing a number of articles of the Law on Organization of the National Assembly and the draft Law on Promulgation of Legal Documents (amended). Member of the Party Central Committee, Minister of Natural Resources and Environment Do Duc Duy attended and spoke at Group 16.
Approving the comprehensive amendment of the Law on Promulgation of Legal Documents
Group 16 includes delegations of National Assembly deputies from Ha Tinh, Lam Dong, Yen Bai and Ca Mau provinces. At the meeting, delegates discussed the draft Law on Promulgation of Legal Documents (amended). Delegates agreed to comprehensively amend the Law on Promulgation of Legal Documents in order to promptly institutionalize the Party's policy on innovation and improvement of the law-making process; contributing to speeding up the progress, improving the quality of drafting and promulgating legal documents, and perfecting institutions to meet the requirements of national construction and development in the new period.
The Draft Law on Promulgation of Legal Documents (amended) has 08 chapters and 72 articles, 101 articles less than the current Law, although the scope of regulation is expanded to include some contents on the responsibility of organizing law enforcement.
At the meeting, delegates proposed a clear separation between the process of proposing, consulting and deciding on policies, and the process of drafting and legalizing decided policies.
In addition, delegates suggested that policy-proposing agencies should host consultation conferences, instead of National Assembly agencies or state agencies. In addition, it is necessary to expand the subjects and scope of consultation, especially inviting opinions from experts, managers and those directly affected by the policy.
Delegates also mentioned that instead of building specialized laws, should we build multi-sectoral laws?
Research is clear and convincing enough, the Law will quickly come into practice.
Further discussion and clarification with the National Assembly delegates raised a number of opinions at the group meeting as well as in the Verification Report on the organization of policy consultation, the scope and composition of the policy consultation conference. Minister Do Duc Duy informed that one of the fundamental innovations of the law-making process in general and according to the draft Law being proposed to the National Assembly is to distinguish and separate the policy-making process and the annual legislative program, as well as separate the drafting process... Because these work groups are very important and when clearly separated, only when the policy is decided clearly enough, convincing enough, then the drafting of the Law can be carried out.
This is to ensure that when the policy proposal stage is done well, once it is legalized, the Law will ensure long-term stability and avoid unwanted social impacts from the proposing agency as well as the National Assembly as a legislative body.
Minister Do Duc Duy gave examples of policies on absolute prohibition of people using alcohol while driving, or adjusting retirement age or regulations related to social insurance... The above contents in the policy proposal process are implemented and carefully researched, the legalization will take place more smoothly and quickly put into practice.
Regarding the opinions of delegates that the organization of policy consultation conferences should be chaired by the proposing agency instead of the National Assembly or other state agencies. At the same time, the scope and participants should be expanded, including experts, managers, researchers and subjects directly affected by the policy. Minister Do Duc Duy said that he would propose that the Government accept the above opinions, which would help improve the quality of consultation, ensure that policies are built closer to reality and have higher feasibility.
Multidisciplinary law-making research
In response to the opinion of the delegate suggesting that each ministry should develop a law instead of making too many laws as it is now, Minister of Natural Resources and Environment Do Duc Duy said that the spirit of arranging the organizational apparatus in the direction of a ministry managing multiple sectors and fields, but "each ministry only has one set of laws, I think that set of laws will be very massive and very difficult to make".
However, the Minister also said that the Government has calculated that, in addition to issuing laws of a specialized and in-depth management nature, it will also expand the scope to build multi-sectoral management laws that only apply to a certain area. "For example, the Capital Law is a multi-sectoral law that regulates many areas but applies to the capital area; or specific resolutions on the development of Ho Chi Minh City or some localities, and in the future there will be resolutions on regional development," Minister Do Duc Duy cited.
Minister Do Duc Duy Duy said that in the near future, there will be projects such as the North-South high-speed railway and the Ninh Thuan nuclear power plant that require many specific mechanisms and policies. Therefore, it is possible to develop multi-sectoral laws to apply to one or several key national projects or to apply to a number of activities that need to be regulated.
With the opinions of National Assembly deputies, Minister Do Duc Duy said that the Government will continue to perfect the legal framework for the construction and operation of a unified, synchronous, transparent, feasible, accessible, effective and efficient legal document system, contributing to removing "bottlenecks", unleashing all potentials and resources, creating new momentum for the country's rapid and sustainable development.
