On June 25, discussing the draft Law on Advertising in the hall, many delegates were concerned about the regulations. Prohibiting notary organizations from advertising in the mass media in the draft Law on Notarization (amended).

Resolution 172 of 2020 of the Government on the policy of developing the notary profession is also encouraging individuals and organizations to notarize contracts and transactions to ensure legal safety, contributing to reducing the workload of administrative agencies, reducing staff and state budget expenditures.

"Introducing notary organizations and notaries helps organizations and individuals understand notary activities and notary organizations, making it easier to find information, especially in areas where notary organizations have just been established," said Mr. Gia.

Also commenting on this issue, delegate Pham Van Hoa (Dong Thap province delegation) said that such a regulation limits the notary's right to provide information and the delegate proposed to remove this regulation.

Also assessing that the ban on advertising by notary organizations is inappropriate, delegate Nguyen Huu Thong (Binh Thuan province delegation) stated that prohibited advertising practices have been stipulated in the law on advertising.

"The prohibited content in the draft Law limits the right to provide information of notaries and notary organizations as well as the right of people to access information of notaries and notary organizations in operation," said Mr. Thong.

Therefore, the Binh Thuan delegation proposed to review and revise regulations on advertising in notary activities to ensure the legitimate rights and interests of notaries and organizations, notaries as well as other related organizations and individuals.

Explaining and clarifying this content, Deputy Prime Minister and Minister of Justice Le Thanh Long affirmed: will carefully study the comments to absorb, explain and complete the draft law to submit to the National Assembly for consideration and approval at the next session.

Regarding the regulation prohibiting advertising in the draft Law on Notarization (amended), Deputy Prime Minister Le Thanh Long said: "The above regulation was introduced based on the approach that this is a public service. Public services are done by the state, and can be socialized for private organizations to do with certain mandatory conditions, but are not commercialized."

In addition, the draft does not completely ban self-introduction tools of notary organizations here, only bans them on mass media and not on websites. Therefore, according to him, there is no fear that the ban on advertising will lead to organizations being unable to introduce themselves.

If organizations do well, operate properly, are trusted by the people, and especially create professional prestige, that is more important than commercial advertising.

"In some countries, they basically prohibit notary organizations from advertising. In some countries that do not prohibit it, they can use technical barriers to limit notary organizations from talking about themselves in the form of advertising like other commercial enterprises," the Deputy Prime Minister further explained.
