Removing difficulties
According to the report of the People's Council of Nui Thanh district, in 2023, based on the feedback of voters, Nui Thanh continues to propose to the Provincial People's Council, the Provincial People's Committee and relevant sectors to implement solutions to remove existing problems and inadequacies in land acquisition, compensation, support, resettlement arrangement, and issuance of land use right certificates (red books) to people when the State acquires land to implement projects in the district, but so far has not been resolved to ensure the legitimate rights of the people. Specifically, there are 675 cases of resettlement in the district but have not been granted red books and other related cases.
Regarding this issue, according to the 2024 Land Law, Clause 4, Article 254 stipulates transitional provisions on land recovery; compensation, support and resettlement when the State recovers land: “In cases where there is a decision to recover land and a decision to approve the compensation, support and resettlement plan before the effective date of this Law, but after the effective date of this Law, there is a decision to allocate land for resettlement, the land price for calculating land use fees at the resettlement site is determined at the time of approval of the compensation, support and resettlement plan; in cases where at the time of the decision to allocate land for resettlement, the resettlement land price is lower than the land price in the compensation, support and resettlement plan, the land price at the time of issuance of the decision to allocate land for resettlement shall apply”.
Thus, the current land law has resolved the problem related to land prices to calculate resettlement land use fees. During the process of receiving documents, depending on the specific case, the People's Committee of Nui Thanh district assigns the district's Department of Natural Resources and Environment to advise on the settlement in accordance with the provisions of law.
Correcting errors
Along with removing difficulties in the land sector, Nui Thanh also rectified violations in the issuance of red books according to the 2024 Land Law. In 2024, the District People's Committee assigned the District Inspectorate to conduct an unscheduled inspection of the issuance of red books to Mr. Phan Ngoc Hoanh (residing in Tra Tay village, Tam My Dong commune).
Through inspection, it is recommended to adjust the plot division diagram of the land arrangement area of Tam My Cooperative (Cay No residential area, Phu Quy 2 village, Tam My Dong commune), and recommend administrative handling of 5 collectives.
Also this year, through inspection and review, the People's Committee of Nui Thanh district issued 2 documents (No. 326, 328/2024) regarding the 2 red books with an area of 13,659m2 of protective forest land granted not in accordance with the provisions of land law in Tam Son commune.
Specifically, the District People's Committee announced the issuance of red book, house ownership rights and other assets attached to land No. BC957689 issued by the People's Committee of Nui Thanh District on December 31, 2010 to Mr. Tran Ngoc Xuan and Ms. Huynh Thi Hanh at land plot No. 966, map sheet No. 01, area 6,972m 2 ; red book, house ownership rights and other assets attached to land No. BC895955 issued by the People's Committee of Nui Thanh District on December 31, 2010 to Mr. Nguyen Tai and Ms. Huynh Thi Thanh at land plot No. 1020, map sheet No. 01, area 6,687m 2 , type of protective forest land is not in accordance with the provisions of the law on land (not for the correct purpose of land use) and must be recovered according to the provisions of Point d, Clause 2, Article 152 of the Land Law 2024.
The People's Committee of Nui Thanh district assigned the People's Committee of Tam Son commune to publicly post this content at the commune People's Committee headquarters, the cultural house of Thuan Yeu Tay village and notify the two families (Mrs. Huynh Thi Hanh and Huynh Thi Thanh).
