After 3.5 working days, the 5th Extraordinary Session completed the entire proposed program and held the Closing Session on the morning of January 18.
At the Session, the National Assembly upheld the spirit of responsibility, promoted democracy and intelligence, frankly discussed, carefully considered and voted to pass the following contents: Land Law (amended); Law on Credit Institutions (amended); Resolution on a number of specific mechanisms and policies to implement national target programs; Resolution on the use of general reserves and central budget reserves of the Medium-term Public Investment Plan for the period 2021 - 2025 for ministries, central agencies, localities and Vietnam Electricity Group.
The contents decided by the National Assembly at this Session are of great importance not only for the implementation of the socio-economic development plan for 2024 and the entire term, but also have fundamental, strategic, and long-term significance, demonstrating the spirit of legislation for the people.
The National Assembly passed the Land Law (amended) consisting of 16 chapters and 260 articles, completing one of the most important legislative tasks of the 15th National Assembly term in accordance with the 2013 Constitution, the Party's policies and guidelines, directly the Resolution of the 13th National Party Congress and Resolution No. 18-NQ/TW dated June 16, 2022 of the 5th Conference of the 13th Party Central Committee.
The National Assembly's approval of the Law on Credit Institutions (amended) at this session contributes to ensuring the safety, soundness, transparency, stability and sustainability of the banking system and credit institutions, developing in accordance with socialist-oriented market principles and common international practices and standards, enhancing competitiveness, and continuing to promote its role as an important capital channel for the economy.
At the press conference, answering reporters' questions related to the Land Law (amended) that has just been passed, Standing Member of the National Assembly's Economic Committee Phan Duc Hieu said that to ensure the synchronous implementation of the Law in practice, when submitting the draft Law, the Government also submitted draft decrees to provide detailed instructions for implementation.
According to preliminary statistics, there are about 65 articles and clauses assigned to the Government for detailed regulations. However, the number of draft decrees is only an estimate because during the implementation process, this number may increase or decrease. The most important thing is that the content must provide complete guidance, it is possible that 1 decree guides many provisions of the Law.
Mr. Phan Duc Hieu expressed his hope that after the Law is passed, the Government will soon have a specific plan to implement the Law, including determining the number of decrees to be issued and which agency will take the lead in presiding over and advising on drafting the decrees.
According to the Standing Member of the Economic Committee, the Land Law (amended) has many new points, focusing on 5 groups of issues.
One is regulations to better protect the legitimate rights and interests of land users such as expanding land use rights for Vietnamese citizens, including those residing abroad; land policies for ethnic minorities...
The second group of issues is the access to land of people and businesses such as regulations on land recovery for the construction of socio-economic infrastructure, serving production and business activities. This is newly designed, fully institutionalizing Article 54 of the Constitution, that is, land recovery is only in cases of real necessity. In addition, expanding regulations related to land agreement mechanisms, changing land use purposes of those who currently have land; expanding land funds; land funds for small and medium enterprises...

The third group of issues is to improve land use efficiency such as land used for multiple purposes; to narrow down the cases requiring permission when changing land use purposes...
The fourth group of issues on land finance includes: separating the issue of land valuation from the land exemption and reduction support policy; some policies to stabilize land rents such as input activities for production and business activities...
The last group of issues is to improve the efficiency and effectiveness of State management, including many reform regulations, reducing administrative procedures, and creating convenience for people.
Besides, according to Mr. Phan Duc Hieu, the most important thing is to improve land data information so that people can easily access it, serving their lives and production and business; there is a mechanism to facilitate people to monitor land-related implementation.
Answering reporters' questions about the significance of the Extraordinary Session, Secretary General of the National Assembly and Head of the National Assembly Office Bui Van Cuong stated: Extraordinary Sessions and Regular Sessions have the same legal value and perform the same tasks and powers, under the authority of the National Assembly.
Moreover, with issues that are mature, clear and have consensus, there is no reason not to pass them. If the Land Law (amended) and the Law on Credit Institutions (amended) are left until next May (7th Session) to be passed, it will slow down development, especially national governance related to this field.
"We have fully grasped the direction of General Secretary Nguyen Phu Trong right at the first meeting of the 15th term. The National Assembly Chairman also regularly grasped that: issues that are mature, clear, and have been tested in practice to be correct should be included in the law. New issues with many different opinions, if found correct, should be piloted, and issues with different opinions that are unnecessary should be left out," Mr. Bui Van Cuong emphasized.
According to the Secretary General of the National Assembly, Head of the National Assembly Office, the Land Law (amended) and the Law on Credit Institutions (amended) have been carefully prepared, working through many sessions, meetings and conferences to review, discuss and reach consensus; issues that have not been agreed upon have not been included and will continue to be considered for piloting before being decided. The explanation, acceptance and revision are also very convincing.
The approval rate for the two draft laws accurately reflects the difficulty and the spirit of careful and meticulous work.
