Many new points in the draft Law on Teachers

TPO - For the first time, regulations for non-public teachers, salary policies, protection policies, attraction policies... are new points in the Draft Law on Teachers, according to the Ministry of Education and Training.

The Ministry of Education and Training said that the Draft Law on Teachers has many new points.

Firstly, for the first time, regulations for non-public teachers are established : the Law on Teachers applies to teachers in public educational institutions and teachers in non-public educational institutions. This helps to “fill” the legal gap for non-public teachers when the Law on Civil Servants only has sanctions for “Vietnamese people recruited and working in public educational institutions”.

For the first time, the legal position of non-public teachers is fully and synchronously established as teachers, not just as workers under the labor contract mechanism.

Second, teachers are standardized through the system of titles and professional standards : According to statistics, the current teaching staff has up to 6 groups of subjects: civil servants, public employees, workers, military officers, police officers, and those who teach and educate at schools in the system of Party agencies, the Front, and mass organizations. The above groups are associated with each level of education and training level, leading to some regulations on teachers being implemented inconsistently and inconsistently.

The Law on Teachers standardizes the teaching staff through a system of titles and professional standards for teachers with standards that closely follow the requirements of professional capacity but still ensure distinct elements associated with each level of education and training.

Third is the recruitment and employment policy associated with the characteristics of professional activities : Regulations on the recruitment of teachers must ensure that they have pedagogical practice in order to select people with sufficient capacity associated with the professional standards of teachers, meeting the professional activities of teachers according to each level of education and training level.

Policies on mobilization, secondment, transfer, inter-school and inter-level teaching for teachers in public educational institutions are fully regulated, serving as a basis for arranging and assigning teachers in accordance with the characteristics of professional activities and the requirements of the education sector.

Fourth is the policy of protecting and attracting teachers : Teachers are protected through rights and things that cannot be done to teachers in the direction of increasing initiative, creativity and increasing protection of teachers in professional activities.

Attract and promote highly qualified people, talented people, people with special gifts, people with high vocational skills to become teachers; teachers participating in teaching and education in ethnic minority areas, mountainous areas, border areas, islands and areas with especially difficult socio-economic conditions.

Fifth is the salary and benefits policy : In the draft Law on Teachers, teachers' salaries are ranked highest in the administrative career salary scale system; there is a priority regime in salary and allowance regime higher than other teachers for preschool teachers; working in particularly difficult areas in ethnic minority areas, mountainous areas, coastal areas and islands; specialized schools, other specialized schools; implementing inclusive education; being ethnic minorities and teachers in some specific professions; Teachers recruited and ranked for the first time are ranked 1 salary level higher in the administrative career salary scale system.

The retirement age of teachers is regulated separately according to the characteristics of their professional activities. In particular, teachers in preschools, if they wish, can retire at a lower age but not more than 5 years older than the regulation and will not have their pension rate deducted due to early retirement. Teachers with the title of professor, associate professor or doctoral degree and teachers working in specific specialized fields and sectors are entitled to retire at a higher age.

The sixth is to increase the autonomy of the education sector : The Draft Law on Teachers also includes the content of the autonomy of the education sector in recruiting and using teachers. In which, the Ministry of Education and Training and the Ministry of Labor, War Invalids and Social Affairs are the agencies in charge of developing strategies, projects, development plans, and total staffing of teachers under their management authority to submit to competent authorities for decision; promulgate recruitment criteria and standards, pedagogical practice content in teacher recruitment/examination; coordinate the staffing of teachers in public educational institutions according to the number assigned by competent authorities.

Educational management agencies take the lead (or delegate authority to educational institutions) in recruiting, mobilizing, arranging, evaluating, and appointing teachers.
