Age limit for train driver's license is different.
The Vietnam Railway Authority has just proposed to amend the regulations on the age of train driver's license. The leader of the Railway Authority said: According to the provisions of the Railway Law, the age to be granted a train driver's license is from 23 to 55 years old for men, from 23 to 50 years old for women; with a certificate of qualified health.

However, the 2019 Labor Code stipulates that the retirement age for men is 62 years old starting from 2028 and for women is 60 years old starting from 2025. Workers with reduced working capacity; Working in particularly arduous, toxic, or dangerous occupations or jobs; Working in areas with particularly difficult socio-economic conditions can retire at a lower age but not more than 5 years older than the prescribed age at the time of retirement, unless otherwise provided by law.
Thus, the regulation on the lowest retirement age of employees (including train drivers) of the 2019 Labor Code is different from the maximum age allowed to be granted a train driver's license prescribed by the 2017 Railway Law.
The lack of uniformity in these regulations has affected the rights of workers and caused difficulties for businesses in employing and arranging jobs for train drivers of railway businesses.
For urban railway train drivers, according to the Vietnam Railway Authority, the regulation on the minimum age to be granted a train driving license is 23 years old for both men and women according to the 2017 Railway Law, which is not suitable for the actual situation.
Because recently, at some new urban railway lines put into operation for the first time in Vietnam, there are training and certification of train drivers for urban train drivers. Accordingly, to learn to drive trains on urban railways, train drivers must be 19 years old after graduating from high school, the average train driving training time is 1-1.5 years; the average trial operation time is 3-6 months.
Thus, at the earliest, students under 20 years old can be granted a certificate to drive urban trains. If the minimum age as stipulated in the 2017 Railway Law is applied, it will cause difficulties for urban railway businesses in training and recruiting train drivers for urban railways. Therefore, adjusting the minimum age to be granted a train driver's license for urban railways is necessary.

Separate regulations for each type of railway
From here, the leader of the Vietnam Railway Authority said that during the process of drafting the revised Railway Law, it will propose, review, amend and supplement regulations on the maximum age for being granted a train driving license to be consistent with the 2017 Labor Code and the minimum age for being granted a train driving license for the position of train driver on national railways, specialized railways and urban railways to be consistent with current reality.
The Vietnam Railway Authority also proposed to review and supplement regulations on decentralization to local authorities to perform the state management function of granting driving licenses for urban and specialized railways.
"This regulation aims to enhance the role and responsibility of localities in state management of railway staff directly serving train operations, including the position of train driver of urban railways and specialized railways, and to carry out the responsibility of local authorities to ensure railway traffic safety, in accordance with the Government's policy of decentralization and delegation of power to local authorities," the Vietnam Railway Authority explained.
