(MPI) - The Government has just issued Decree 17/2025/ND-CP amending and supplementing a number of articles of the Decrees detailing a number of articles and measures to implement the Law on Bidding.

Specifically, Decree No. 17/2025/ND-CP has amended and supplemented a number of articles of 4 Decrees guiding bidding. Firstly, Decree No. 23/2024/ND-CP dated February 27, 2024 of the Government detailing a number of articles and measures to implement the Law on Bidding on selecting investors to implement projects in cases where bidding must be organized according to the provisions of the law on industry and sector management.
Second, Decree No. 24/2024/ND-CP dated February 27, 2024 of the Government detailing a number of articles and measures to implement the Law on Bidding on contractor selection.
Third, Decree No. 115/2024/ND-CP dated September 16, 2024 of the Government detailing a number of articles and measures to implement the Law on Bidding on selecting investors to implement investment projects using land.
Fourthly, Decree No. 95/2020/ND-CP dated August 24, 2020 guiding the implementation of procurement bidding under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership has been amended and supplemented by a number of articles in Decree No. 09/2022/ND-CP dated January 12, 2022 guiding the implementation of procurement bidding under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership, the Free Trade Agreement between the Socialist Republic of Vietnam and the European Union, and the Free Trade Agreement between Vietnam and the United Kingdom of Great Britain and Northern Ireland.
Decree 17/2025/ND-CP takes effect from February 6, 2025. At the same time, Article 5 of the Decree has the following transitional provisions on bidding: Bidding packages that have been approved and issued with invitations for expression of interest, invitations for pre-qualification, invitations for bids, and request documents before January 15, 2025 will continue to organize shortlisting, contractor selection, signing and contract implementation management in accordance with the provisions of Bidding Law No. 22/2023/QH15, Decree No. 24/2024/ND-CP and detailed regulations and implementation instructions.
During the period from January 15, 2025 to the effective date of this Decree, the selection of contractors shall be carried out in accordance with the provisions of the Bidding Law No. 22/2023/QH15, the Law amending and supplementing a number of articles of the Law on Planning, the Investment Law, the Law on Investment under the public-private partnership method and the Bidding Law and the contents of Decree No. 24/2024/ND-CP which are also consistent with the provisions of the Law amending and supplementing a number of articles of the Law on Planning, the Investment Law, the Law on Investment under the public-private partnership method and the Bidding Law.
For draft international treaties on behalf of the State that have completed the process of appraising draft international treaties according to the provisions of the Law on International Treaties before the effective date of the Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding, the negotiating agency shall submit to the Government for application the provisions of the sponsor or international organization of which the State and the Government of the Socialist Republic of Vietnam are members, which have different provisions on bidding or have not been specified in the Law on Bidding on the basis of the appraised draft international treaty dossier./.
