The Ministry of Transport has just issued Circular 44/2023 amending and supplementing Circular 18/2019 providing guidance on the implementation of Decree 139/2018 and Decree 30/2023 of the Government on motor vehicle inspection service business, effective from February 15, 2024.

Accordingly, the Circular has provided specific instructions on the implementation of decentralization of management of motor vehicle inspection activities from the Vietnam Register to local Departments of Transport.

Regarding the licensing of vehicle inspection units, the Circular stipulates: After completing the investment and construction in accordance with the provisions of law, the organization establishing the vehicle inspection unit shall prepare a set of documents requesting a certificate of eligibility to operate motor vehicle inspection and send it to the Department of Transport.

This agency is also responsible for establishing inspection teams, evaluating and issuing certificates of eligibility for motor vehicle inspection activities.

In the delegation, there must be at least one member who has completed the training course on inspection and evaluation of motor vehicle inspection activities organized by the Vietnam Register according to regulations.

The inspection and assessment contents include: Facilities, Testing equipment and tools, Organizational structure, human resources; Building and promulgating internal procedures; Operation of the inspection line and Opening of monitoring books according to regulations.

Every year, the Department of Transport must develop a plan to inspect and evaluate the maintenance of conditions regarding facilities, organizational structure, human resources and inspection activities of inspection units in the area to ensure that inspection units comply with regulations on motor vehicle inspection service business.

The contents of inspection and assessment of maintaining the operating conditions of inspection units include: Facilities, Inspection equipment and tools, Organizational structure, human resources; Checking records and data; Log books, reporting regime, management of stamps and compliance with regulations on price and fee collection; Checking and re-evaluating inspection results and compliance with regulations on price and fee collection and payment.

Circular 44 also stipulates cases of surprise inspection of motor vehicle inspection activities, including: When there are well-founded complaints and feedback about violations in inspection activities; There are written requests from competent authorities; When there are signs of abnormalities in inspection activities (through the monitoring system, analysis of inspection database).

The competent authority to conduct surprise inspections is the Vietnam Register, Department of Transport.

Regarding the retention of records of inspection, assessment and issuance of certificates of eligibility for motor vehicle inspection activities, including records of applications for certificates of eligibility for motor vehicle inspection activities, inspection and assessment records and accompanying documents (if any), the Circular stipulates that they must be stored at the inspection unit (permanently) and the Department of Transport, the Vietnam Register as a basis for inspection and assessment of the maintenance of conditions for motor vehicle inspection activities.

Records of inspection, assessment of maintenance and surprise inspection of operating conditions of motor vehicle inspection are kept at the vehicle inspection and transport unit for a minimum period of 5 years.

Circular 44 also specifies the content of professional training for vehicle inspectors instead of being general as before.

Accordingly, theoretical training must include the following contents: History of formation; professional ethics; communication skills; legal regulations on measurement; regulations on responsibilities, tasks, and powers; legal documents, standards, regulations, procedures, and professional instructions; regulations on motor vehicle renovation; inspection methods; and use of software.

Similar to current regulations, the Circular stipulates that interns at the inspection unit must: Practice using the program system and software; Practice the stages of inspection and evaluation of vehicles on the inspection line.

However, it is added that students must prepare a report on their internship as a motor vehicle inspector.

Notably, the Circular clearly stipulates the number of practice vehicles on the assembly line for each trainee according to the classification of internship time corresponding to each person's experience. This helps to take advantage of human resources such as experienced auto engineers, repair and maintenance technicians to supplement the current shortage of inspectors.

Specifically, for students with a 3-month internship, they must practice at least 100 vehicles/stage of many different types of vehicles (can practice many stages on one vehicle), in which each stage of practice must have at least 25 trucks and 25 passenger cars. Particularly, the preparation of vehicle records must be done for at least 100 vehicles.

Trainees have a 6-month internship period, practicing at least 200 vehicles/each stage of many different types of vehicles (can practice many stages on one vehicle), in which each stage practices at least 50 trucks, 50 passenger cars. Vehicle documentation must be done for at least 200 vehicles.

Trainees have a 12-month internship period, practicing on at least 400 vehicles/each stage of many different types of vehicles (can practice multiple stages on one vehicle), in which each stage practices at least 100 trucks, 100 passenger cars. Particularly, vehicle documentation must be done on at least 400 vehicles.

The internship instructor must be an inspector with at least 36 years of experience and is responsible for the trainee's internship content.

The Circular also adds many regulations to increase the responsibility of inspection units. Accordingly, these units are required to ensure independence, objectivity, transparency, and not be influenced by any factors that affect the inspection results.

In addition, the inspection unit also has additional responsibilities: Sending people to participate in training, updating and supplementing the professional skills of inspection officers and professional staff; Developing and promulgating internal procedures of the inspection unit; Complying with the implementation of financial obligations related to inspection activities; Quarterly reporting on the use of inspection seals according to regulations.

At the same time, it is responsible for providing camera surveillance accounts to the Vietnam Register and the Department of Transport to monitor motor vehicle inspection activities; uniformly using the software system for managing motor vehicle inspection activities transferred by the Vietnam Register and the software for controlling inspection equipment announced by the Vietnam Register .
