On March 17, according to Thanh Nien reporter's source, Ca Mau Provincial Police initiated a case at Ca Mau Housing Investment and Development Joint Stock Company (Ca Mau Housing Development Company) related to the transfer of land use rights of more than 13,560 m2 to Thien Tan Company Limited.
"The Investigation Police Agency is consolidating the case file to prosecute the suspects related to the case. At the same time, the exit ban period for those involved is extended," the source added.
Ca Mau Housing Development Company transferred land to Thien Tan Company Limited with a price difference of more than 11 billion VND.
As Thanh Nien reported, previously, many retired officials of Ca Mau province reported to the Government Inspectorate that Thien Tan Company Limited received the transfer of prime land from Ca Mau Housing Development Company without auctioning land use rights, and has not yet collected the money, and has allocated land to carry out a housing project for many years but has not implemented it.
During the inspection and verification, the Government Inspectorate stated that during the implementation of the Thanh Phu residential area project in 2016, Thien Tan Company Limited (the investor of the Thanh Phu residential area project - PV) received the transfer of 13,562.60 m2 of land from Ca Mau Housing Development Company for VND 15.558 billion. At the time of the transfer, Ca Mau Housing Development Company did not ask for the opinion of the owner of the State capital, which is a violation of the provisions of Article 20 of Decree No. 99/2012/ND-CP of the Government and Article 6 of Circular 21/2014/TT-BTC of the Ministry of Finance.
On the other hand, this transfer did not re-determine the value at the time of transfer and did not organize an auction, which is a violation of the provisions of Clause 3, Article 16 of the Financial Management Regulations issued together with Decision No. 9/QD-HDQT dated October 6, 2016 of the Board of Directors of Ca Mau Housing Development Company.
Notably, the value according to the transfer contract compared to the value calculated according to the land price adjustment coefficient method issued by the People's Committee of Ca Mau province for the 13,562.60 m2 land area has a price difference of more than 11 billion VND.
Thus, the improper implementation of regulations led to the loss of State capital at Ca Mau Housing Development Company (at the time of transfer, Ca Mau Provincial Development Investment Fund held 97.28% of charter capital). Therefore, according to the Government Inspectorate, the case should be transferred to the Investigation Police Agency for investigation and handling according to regulations.
