Regarding the case of "Strange story: Commune Chairman authenticates land sale contract via... Zalo" that Nguoi Lao Dong Newspaper had a series of articles reflecting, on the morning of January 15, Mr. Nguyen Dinh Nguyen (55 years old; residing in My Chanh commune, Phu My district) said that a representative of Phu My district police had just contacted him to invite him to the headquarters to work at 2:00 p.m. the same day.
The old red book of land plot number 875 is still being kept by Mr. Nguyen Dinh Nguyen's family.
"The police agency asked me to provide documents related to the case of the commune chairman certifying the land sale contract via Zalo at the first working session. I hope the case will be clarified soon to protect the legal rights of our family" - Mr. Nguyen informed.
In another development, Mr. Tran Van Phuc, Secretary of Phu My District Party Committee, said that after the Lao Dong Newspaper reported, he directed the district's functional agencies to investigate the case of the commune chairman certifying a land sale contract via Zalo. Thereby, if any violations as reported by the newspaper are discovered, they will be strictly handled according to regulations.
As reported by Nguoi Lao Dong Newspaper, Mr. Nguyen Dinh Nguyen has just sent a complaint to the authorities about the local government certifying the land use rights transfer contract in violation of regulations, causing his family to lose the entire plot of land, causing losses of billions of dong.
Specifically, in 1998, his wife's family of 11 people was granted a land use right certificate (red book) for plot number 875, area 539.9 m2 in Trung Thuan village, My Chanh Tay commune, Phu My district, by the People's Committee of Phu My district. At that time, the red book was issued under the name of his wife's mother, Mrs. Tran Thi Cuoc - representative of the family of 11 people.
Because he wanted to take over plot 875, in mid-2020, his wife's brother, Mr. Nguyen Van Thinh (57 years old; currently residing in Lam Dong province), went to the People's Committee of My Chanh Tay commune to report the loss of the red book and carried out procedures to get it reissued. Meanwhile, the whole family did not know about this and was still holding the red book.
On October 1, 2020, the Department of Natural Resources and Environment of Binh Dinh province issued a new red book for land plot 875. On this red book, the person who was granted the certificate still wrote the name "household of Mrs. Tran Thi Cuoc".
After receiving the new red book, with the help of the representative of the People's Committee of My Chanh Tay commune, Mr. Nguyen Van Thinh successfully sold his family's land plot 875 to Mr. Pham Van Tri (53 years old; residing in My Chanh commune, Phu My district) under a contract to transfer land use rights against regulations, established on October 5, 2020. The incident caused Mr. Nguyen's family to lose the entire land plot, with a loss of about 4-5 billion VND.
The illegal certification of the transfer contract for land plot 875 by the People's Committee of My Chanh Tay commune caused Mr. Nguyen Dinh Nguyen's wife's family to lose billions of dong.
Speaking with a reporter from Nguoi Lao Dong Newspaper, Mr. Nguyen Van My - Deputy Secretary of the Party Committee of My Chanh Tay Commune, former Chairman of the People's Committee of My Chanh Tay Commune - admitted that he signed the certification of the land transfer contract. 875 between Ms. Tran Thi Cuoc and Mr. Pham Van Tri is against the regulations. Explaining why the red book was issued to a household of 11 people but only one person signed the transfer contract and it was still certified, Mr. My said that he signed it because he trusted the judicial staff (!?).
However, when the reporter asked why at the time of establishing the contract, Ms. Tran Thi Cuoc was not present at the headquarters of the People's Committee of My Chanh Tay commune to sign but was still certified, Mr. My explained: "At that time, someone called via Zalo application for video call, I looked at the phone screen and saw Ms. Cuoc in Lam Dong holding a pen and signing on the paper, so I signed to certify"!
Lawyer Duyen Tran - MZI Law Firm, Da Nang City Bar Association - determined that the land use rights transfer contract dated October 5, 2020 for land plot No. 875 between Ms. Tran Thi Cuoc and Mr. Pham Van Tri is illegal.
For Mr. Nguyen Van Thinh, if it can be proven that Mr. Thinh clearly knew that the land plot was the common property of 11 family members but deliberately concealed it and forged the handwriting of his biological mother, Ms. Tran Thi Cuoc, to sign the transfer contract in order to appropriate the transferee's money, he could be prosecuted for the crime of Fraudulent Appropriation of Property under Article 174 of the Penal Code.
As for the person receiving the certification file (judicial officer) and the person performing the certification (Mr. Nguyen Van My, former commune chairman), these people intentionally violated their official duties, causing damage to Ms. Tran Thi Cuoc's family. If it is proven that there was personal gain, they may be prosecuted for the crime of Abusing position and power while performing official duties under Article 356 of the Penal Code. If it is not proven that there was personal gain or other personal motives, they may be prosecuted for the crime of Lack of responsibility causing serious consequences under Article 360 of the Penal Code.
