The Ministry of Education and Training has just announced the Draft Decree amending and supplementing a number of articles of Decree No. 14/2013 of the Government regulating the reimbursement of scholarships and training costs for those studying with the state budget to collect comments.
Increase the cost repayment period
According to the Ministry of Education and Training, after summarizing 10 years of implementing Decree 143 and organizing a survey and assessment of the actual implementation of this decree, the Ministry found that there are still some limitations and problems.
Specifically, the scope of regulation and subjects of application of the Decree do not cover all cases of being sent to study using the state budget. For example, cases of studying at schools belonging to the police, the army or being sent by the army to study at schools outside the army; cases of studying domestic training programs using the state budget that are not included in the training order project approved by the Prime Minister...
Pedagogy students studying with state budget will be subject to the Decree on scholarship and training cost reimbursement.

In addition, the time for learners to make a refund is too short, making it difficult for learners to fulfill their refund responsibilities, limiting the feasibility of implementing the Decree. In addition, the regulation that the fee must be repaid in one go also causes difficulties for learners.
The Decree also does not have regulations on cases of exemption or reduction of compensation costs. Therefore, it does not ensure consistency and uniformity with other legal documents on compensation, and at the same time, it causes some difficulties for students facing economic and health difficulties, etc.
Therefore, the draft adds the subject of application as "learners participating in domestic training programs using state budget sources".
Regarding the deadline for payment and recovery of compensation costs, the Draft Decree amends and supplements the deadline for reimbursement costs from 60 days to 120 days. Specifically, within 120 days at the latest from the date of receipt of the decision of the competent state agency, the learner or the learner's family in Vietnam is responsible for paying the full amount of compensation.
In which, the reimbursement cost includes tuition, scholarships and other expenses for the course that have been provided by the state budget.
Some cases are exempted from compensation costs
To ensure consistency and unity with other legal documents on compensation, on the principle of supporting cases where learners have health and economic difficulties, while still ensuring that learners are responsible for fulfilling their obligations to the state and preventing cases of policy abuse, the draft Decree proposes regulations on exemption and reduction of compensation costs for a number of cases.
Firstly, the learner has a serious illness and is unable to work or has passed away: It is recommended that the compensation fee be waived because the learner does not have the ability or conditions to make the compensation.
Second, the student is from a poor household. In fact, in this case, the student is qualified to perform the state's work assignment but does not do so, so in principle, the student must fulfill the responsibility of compensation. However, to be consistent with the general policy of the state on support for poor households, the draft Decree proposes to reduce the compensation cost by 20% to support the student.
Who has to pay for scholarships and training costs?
Learners sent by competent state agencies to study abroad using state budget funds (including educational programs under agreements signed with the Vietnamese government); learners are allowed to participate in domestic training programs using state budget funds or according to training order projects approved by the Prime Minister; if they do not comply with the work assignment of competent state agencies within 12 months from the date the learner is recognized as a graduate, they will have to reimburse the scholarship and training costs.
In case after graduation, if the competent state agency allows to continue studying, the period is 12 months from the date of recognition of graduation from the next course.
Regarding the time of assignment: Students studying at university and college level after graduation must comply with the assignment of work by the competent state agency for twice the time of receiving training costs.
Students studying for a master's or doctoral degree after graduation must comply with the work assignment of a competent state agency for three times the time they are entitled to receive training expenses.
If you have worked under the state's assignment but do not comply with the above time, or voluntarily quit your job, you must also reimburse the costs.
