Vice Chairman of the City People's Committee Nguyen Trong Dong has just signed and issued Decision No. 5665/QD-UBND dated October 29, 2024 on the allocation of 11,859.3 square meters of land in Phu Tuc commune, Phu Xuyen district to the People's Committee of Phu Xuyen district to implement the project of building technical infrastructure for the land use rights auction area in the Livestock Wing area adjacent to Hoang Phat Company, Duong La village, Phu Tuc village, Phu Tuc commune, Phu Xuyen district.

Accordingly, 11,859.3 square meters of land in Phu Tuc commune, Phu Xuyen district (public land managed by Phu Tuc commune People's Committee; confirmed by Phu Xuyen district People's Committee to have completed site clearance in Report No. 504/BC-UBND dated August 8, 2024) was transferred to Phu Xuyen district People's Committee to implement the project of building technical infrastructure for the land use rights auction area in the Livestock Wing area adjacent to Hoang Phat Company, Duong La village, Phu Tuc village, Phu Tuc commune, Phu Xuyen district according to Resolution No. 10/NQ-HDND dated July 14, 2022 of Phu Xuyen district People's Council on approving the investment policy of the Project; Decision No. 8015/QD-UBND dated December 30, 2023 of Phu Xuyen district People's Committee on approving the Project.

The location and boundaries of the land plot limited by the markers: M1, M2, M3, M4, M5, M6, M7 on M1 are determined in the Master Plan Drawing (locally adjusted) at a scale of 1/500 of the project to build technical infrastructure for the land use rights auction area in the Livestock Wing area adjacent to Hoang Phat Company, Duong La village, Phu Tuc village, Phu Tuc commune, Phu Xuyen district, established by NHP Construction Joint Stock Company in August 2023, confirmed by Phu Xuyen District People's Committee on November 1, 2023 and approved with Document No. 2142/UBND-QLDT dated November 2, 2023.

Of the total area of ​​11,859.3m2 of land, there are 6,488m2 of residential land (including plots of land with symbols DG-01, DG-02, DG-03, DG-04) for management and organization of land use rights auctions according to regulations. Form of land use: For Phu Xuyen District People's Committee: land allocation without land use fees. For the winner of the land use rights auction: The State allocates land with land use fees. The land use period is long-term. 5,371.3m2 of traffic and technical infrastructure land: Form of land use: Land allocation without land use fees.

Phu Xuyen District People's Committee is responsible for investing in the construction of technical infrastructure in sync with the general technical infrastructure of the area according to the approved planning. The method of land allocation is not through auction of land use rights, not through bidding to select investors to implement projects using land.

The City People's Committee assigned the Phu Xuyen District People's Committee (Phu Xuyen District Land Fund Development Center) to be responsible for contacting the Department of Natural Resources and Environment to receive land handover on site. Organize the implementation of technical infrastructure construction according to the approved investment project to ensure the overall planning, synchronous connection of technical infrastructure and regional infrastructure.

Phu Xuyen District People's Committee is responsible for preparing and approving the Master Plan Drawing to ensure that there is no interleaved land area, and that land is used economically and effectively. Prepare a plan for auctioning land use rights and submit it to the competent authority for approval and organize the auction of land use rights in accordance with the order and procedures prescribed by the 2024 Land Law, the 2016 Law on Property Auction, and the Decrees and Circulars guiding the implementation.

Phu Xuyen District People's Committee reviews the provisions in Article 7 of Decision No. 61/2024/QD-UBND dated September 27, 2024 of the City People's Committee before organizing the preparation of the Land Use Rights Auction Plan to ensure compliance with legal regulations, publicity, transparency and efficiency. Guide the auction winners to fulfill their financial obligations, register land use rights, prepare documents to apply for Construction Permits and Certificates of Land Use Rights, House Ownership Rights and other assets attached to land according to regulations. Use land for the correct purpose, boundary and area specified above; implement investment projects according to the provisions of law.

The City People's Committee assigned the Department of Natural Resources and Environment to be responsible for guiding the procedures for determining boundary markers and handing over land in the field, granting certificates of land use rights, house ownership rights and other assets attached to land.

Hanoi Land Registration Office updates land use rights registration, performs change registration procedures, and corrects land changes in cadastral records according to regulations.

The Department of Justice guides the People's Committee of Phu Xuyen district to organize land use rights auctions according to the 2016 Law on Property Auctions and other relevant specialized laws.
