According to the Ministry of Justice, for the first time, the phrase "culture of law compliance" was mentioned in Notice No. 108-KL/TW dated November 18, 2024 of the Central Party Office on the Conclusion of General Secretary To Lam at the working session with the Party Committee of the Ministry of Justice. It emphasized the requirement: "Innovating the work of disseminating and educating the law and focusing on building a culture of law compliance, first of all among cadres, party members and cadres and party members in the judiciary sector".
At the workshop with the theme "Discussing the content, criteria for assessing and measuring the culture of law compliance" recently organized by the Ministry of Justice, Deputy Director of the Department of Dissemination, Education of Law and Legal Aid (Ministry of Justice) Phan Hong Nguyen emphasized that building a culture of law compliance is not only a goal, but also a solution to promote the process of perfecting the socialist rule of law state in Vietnam. Legal culture must become the foundation of ethical life and standards of conduct in every organization and every citizen.
According to Mr. Phan Hong Nguyen, to properly understand the concept of "culture of law compliance", it is necessary to clarify two fundamental factors: "culture" and "law compliance". Culture is the crystallization of knowledge, ethics, lifestyle and values. Law compliance is not simply an act of not violating the law, but a responsible, proactive and self-conscious attitude towards the provisions of the law.
Therefore, the culture of law compliance is understood as "habits, lifestyles, values, norms, beliefs and behaviors that are formed, maintained and widely accepted in the community, demonstrating a positive attitude and self-awareness and initiative of individuals and organizations in properly, fully and promptly implementing legal regulations, and at the same time not doing things that are prohibited by law".
For the community, the legal cultural environment is reflected through: "Legal behaviors become common behavioral habits; institutions such as families, schools, and residential groups contribute to legal education; state agencies perform public duties transparently; people participate in monitoring and criticizing society in a civilized and responsible manner."
According to Professor Do Van Dai, Vice Principal of Ho Chi Minh City University of Law, it is necessary to explain the differences between legal awareness, legal compliance and legal culture. Legal compliance is only a part of legal culture.
Prof. Dr. Nguyen Minh Doan, Hanoi Law University, sees the culture of law compliance as the feeling of intolerance towards law-breaking acts; having the right attitude towards the law (not being afraid, not disregarding the law), not boycotting, inciting, or hindering those who actively participate in legal activities...
However, experts say that the situation of law violations is still complicated, especially cybercrime, civil and administrative violations. Many localities are slow to access legal information, officials are not exemplary, dissemination work is still formal, and has not created a habit of voluntary compliance among the people...
Therefore, in order for the culture of law compliance to become a standard of conduct, it is necessary to first improve people's knowledge, especially in remote areas; at the same time, perfect the legal system to be easy to understand, easy to access, public, transparent, close to reality, suitable for the interests of the majority of people, ensuring fairness;
In addition, it is necessary to propagate and educate legal knowledge to all classes of people in a close, practical, easy-to-understand, easy-to-remember way... In particular, people also need to make efforts to continuously learn to fully improve their awareness of the law...
