National Assembly delegates agreed that reforming the apparatus is a necessary step for national development.

(TN&MT) - On the morning of February 13, at the meeting of Group 16 (including the Yen Bai National Assembly Delegation, Ha Tinh National Assembly Delegation, Lam Dong National Assembly Delegation, Ca Mau National Assembly Delegation) at the 9th regular session, delegates discussed in the group two draft laws: the Law on Government Organization and the Law on Organization of Local Government, amended. These are two important draft laws in the process of reforming the state apparatus, aiming to build a more streamlined, effective and dynamic political system.


Background and importance of amending the laws

Speaking at the meeting, Minister of Home Affairs Pham Thi Thanh Tra (National Assembly Delegation of Yen Bai Province) said that these two draft laws were developed in a very special and urgent context. Reforming the state apparatus is an inevitable requirement to improve the effectiveness of management and administration, thereby creating strong changes in the operation of the political system. Reforming the apparatus is not simply about streamlining the payroll but must also meet the requirements of improving the effectiveness, efficiency and performance of state administrative agencies.

The Minister of Home Affairs said that in the process of drafting these revised laws, the drafting agencies have applied a new way of thinking about law-making. Specifically, the laws only regulate issues of general and fundamental principles, in order to ensure stability and long-term applicability in practice. This will help the provisions of the law have long-lasting vitality and be flexible in the actual management of the state administration.

One of the highlights of this amendment to the Law on Government Organization is the reduction in the number of articles and chapters in the law. According to Minister Pham Thi Thanh Tra, this amendment to the Law on Government Organization has cut 18 articles and 1 chapter, leaving only 30 articles, significantly simplifying it compared to the current law.

Ms. Tra said that this reflects the innovation in Vietnam's law-making thinking, when countries with streamlined administrative systems such as China and Japan also have similar laws with much fewer provisions (China's State Council Law has only 20 articles, while Japan's Cabinet Law has 23 articles).

This not only reflects the international trend but also helps improve the effectiveness of the implementation of Government regulations. The Minister added that the goal of this amendment is to clearly define the authority of the Government and local government agencies. The clear division of responsibilities and powers between the Government and ministries and branches as well as between the Government and executive, legislative and judicial agencies is very important, helping to avoid overlap, waste of time and difficulties in the operation process.

Synchronization between Central and local levels in apparatus reform

Along with the amendment of the Law on Government Organization, the Law on Local Government Organization is also adjusted to ensure consistency and unity among government agencies at all levels. The provisions in the draft revised Law on Local Government Organization focus on clearly defining the roles and powers of the People's Councils (PCs), People's Committees (PCs) and Chairmen of People's Committees at all levels, helping to enhance the effectiveness of local government operations.

Ms. Tra also shared that the division of authority and responsibility between levels of government is not only a technical legal issue but also a strategic issue in leadership and management. The relationship between the Government and local authorities will be designed to be clear, avoiding the situation of piling up work to higher levels, while creating conditions for local agencies to be proactive in handling their specific issues.

Solving policy issues for retired officials and streamlining the apparatus

During the discussion, Ha Tinh Provincial Party Secretary Hoang Trung Dung (Head of the National Assembly Delegation of Ha Tinh Province) raised issues related to the implementation of Decrees 177 and 178, especially regarding policies for officials who are not re-elected, re-appointed, and officials who retire early. Mr. Dung said that in Ha Tinh, some officials have retired early according to the requirements of streamlining the apparatus, however, the treatment policies for these officials are not consistent among agencies.

Specifically, Mr. Dung said that in some cases, cadres of the Propaganda Department and the Mass Mobilization Department enjoy a fairly high retirement regime, while cadres in other agencies do not enjoy such a policy. He proposed that the Ministry of Home Affairs and the Central Organization Committee consider allowing localities to use local budgets to supplement the regime for cadres who retire early under Decree 177, helping to ensure fairness and create conditions for localities to implement the policy of streamlining the apparatus more effectively.

In addition, Mr. Dung also expressed concerns about retaining competent officials after the restructuring and streamlining of the apparatus. The Secretary of the Ha Tinh Provincial Party Committee suggested that there should be a reasonable policy mechanism to encourage competent and qualified officials to stay and work, avoiding the situation of retirement or job transfer without making long-term contributions to the locality.

"We really want the district level to be able to increase the number of vice chairmen and deputy secretaries," he suggested.

Mr. Dung cited the example of the 2 merged departments having 7-8 deputy directors, very capable, very young, if they stay for 5 years, they must be adjusted to the correct number of reductions. If they are rotated to the districts, these cadres will be able to develop, especially when at the grassroots level there is a lot of work.

Another thing that the Secretary of Ha Tinh proposed was the process of merging functional agencies, the Central Government should unify the direction, that is, localities should only implement the departments and branches that the Central Government has suggested.

Reforming the apparatus is a necessary step for development.

Speaking at the meeting, Head of the Central Organizing Committee Le Minh Hung (Ha Tinh Province National Assembly Delegation) spoke about issues arising in the implementation of Decrees 177 and 178, especially in the context of localities restructuring and streamlining their apparatus. Mr. Le Minh Hung commented that although there are many difficulties in implementation, this is a necessary revolution to improve the efficiency of the state administrative apparatus.

Mr. Le Minh Hung said that the Politburo has directed to amend and supplement Directive 35 to comply with the requirements of preparing for Party Congresses at all levels, creating favorable conditions for localities in implementing the arrangement and reorganization of the state apparatus. However, he also noted that localities need to strictly implement Directive 35 and only reorganize agencies that the Central Government has instructed, avoiding the situation of arbitrarily implementing changes that are not in accordance with the Central Government's requirements.

“It is clear that the time to reorganize the apparatus coincides with the time to prepare for the Party Congresses at all levels, so there are some inconsistent regulations. Some localities have reported that yesterday I also discussed with the Permanent Deputy Prime Minister and the Minister of Home Affairs and agreed that these are well-founded recommendations and will also handle any problems that arise in practice,” Mr. Hung said.

Head of the Central Organizing Committee Le Minh Hung suggested that the Ministry of Home Affairs report to the Government Party Committee so that this week it can report to competent authorities for consideration and synchronous handling.

On the other hand, Head of the Central Organizing Committee Le Minh Hung also noted that, in addition to handling policies, localities must pay attention to streamlining along with appropriate policy mechanisms to retain capable, qualified, and dedicated cadres.

Regarding the proposal to increase district-level leadership, the vice chairman, deputy secretary, and head of the Central Organizing Committee noted that first of all, localities must strictly implement Directive 35 on preparing for Party Congresses at all levels, including the number of Party committees and Standing Committees of Party committees at all levels...

The Head of the Central Organizing Committee added that after streamlining and reorganizing the apparatus, the Politburo has revised and supplemented Directive 35, preparing a step for Party Congresses at all levels accordingly.

“This does not mean that we have completed the implementation of Resolution 18, but this is just the first step. There are many more tasks to be implemented this year and in the next term,” emphasized Head of the Central Organizing Committee Le Minh Hung.

At the meeting, National Assembly delegates agreed that reforming the state apparatus is an urgent requirement to improve the effectiveness of national management and administration. Amending the Law on Government Organization and the Law on Local Government Organization is the first step in this process, aiming to build a streamlined, effective apparatus that meets development requirements in the new period.

Along with that, the authorities need to continue to coordinate closely to resolve problems arising during the implementation process, while ensuring that policies for retired officials and streamlining the apparatus are implemented fairly and reasonably. The proposals and opinions of the delegates will continue to be considered and perfected in the next process, with the goal of building a strong, effective and close-to-the-people political system.
