Accordingly, the Investigation Police Agency proposed to prosecute the defendants including: Nguyen Minh Quan (former Director of Thu Duc City Hospital) and Nguyen Lan Anh (former Deputy Director of Thu Duc City Hospital) for violating bidding regulations causing serious consequences; Pham Vu Phong (Director of Nam Phong Company) for violating bidding regulations causing serious consequences and bribery.
Defendant Truong Thi Bao Tran (medical equipment and supplies staff of Thu Duc City Hospital) was proposed to be prosecuted for violating bidding regulations causing serious consequences and accepting bribes; Mai Le Quyen (Head of Microbiology Department, Thu Duc City Hospital) was proposed to be prosecuted for accepting bribes.

According to the additional investigation, in his role as Director of Thu Duc City Hospital, in late 2020 and early 2021, defendant Nguyen Minh Quan directed his subordinates to legalize documents to pay for the number of Covid-19 test kits previously supplied by Viet A Company and Nam Phong Company. The supply of these test kits did not include a review of the contractor's capacity and experience, or a bidding process as prescribed.
The criminal acts of Nguyen Minh Quan and his accomplices caused damage to Thu Duc City Hospital of more than 14.9 billion VND.
Bidding fraud, bribery related to Viet A Company
Regarding the criminal acts of the accused Pham Vu Phong, the KLĐT added that Nam Phong Company did not have sufficient legal status as a contractor, but the accused still used this company to commit acts of collusion and fraud in bidding related to Thu Duc City Hospital, including: 1 competitive bidding package, 4 shortened bidding packages, 33 bidding packages to purchase Covid-19 test kits produced by Viet A Company from Nam Phong Company, causing damage to the hospital of more than 14.9 billion VND.
Defendant Phong benefited from Viet A Company's discount on the price of Covid-19 test kits by more than 10.5 billion VND.
At the same time, through Le Trung Nguyen (employee of Viet A Company), Pham Vu Phong gave more than 997 million VND to Thu Duc City Hospital staff to pay commission for completing documents so that Thu Duc City Hospital could pay for the purchase of Covid-19 test kits for Nam Phong Company.
The defendant Truong Thi Bao Tran received 997 million VND in "commission" from Nam Phong Company when completing the documents for Thu Duc City Hospital to pay for the purchase of Covid-19 test kits, causing damage to the hospital. Tran voluntarily returned this amount before being prosecuted.
According to the supplementary KLĐT, regarding the consequences of damage, the maximum price of the test kit produced by Viet A Company (including 5% profit) is 143,461 VND/test kit. The amount that Thu Duc City Hospital paid to Viet A Company and Nam Phong Company to buy the test kit was more than 24.9 billion VND, of which Thu Duc City Hospital paid more than 640 million VND to Viet A Company and paid 24.3 billion VND to Nam Phong Company (8.9 billion VND has not been paid yet).
Because individuals at Thu Duc City Hospital did not follow the bidding process correctly, Thu Duc City Hospital did not buy at the price that Viet A Company sold at 143,461 VND/test kit, causing the hospital to lose more than 14.9 billion VND.
Nam Phong Company benefited from selling test kits to Thu Duc City Hospital by more than 10.5 billion VND, excluding taxes payable to the state.
