According to AFP , after Donald Trump was re-elected last week, Special Prosecutor Jack Smith filed a petition with the 11th Circuit Court of Appeals on November 13, requesting a stay of the prosecution of Trump until December 2. Special Prosecutor Smith said the suspension was to allow the government to "assess this unprecedented situation and determine the appropriate course of action in the future consistent with Department of Justice policy." The Department of Justice has long had a policy of not prosecuting a sitting president. Last week, a federal judge also granted Smith's request to halt a lawsuit against Trump for conspiring to overturn the results of the 2020 presidential election. Trump's re-election comes amid a number of legal challenges, including a lawsuit over conspiracy to overturn the 2020 election results and mishandling classified documents after leaving office in 2021. Trump was due to be sentenced in July, but his lawyers have asked for the sentence to be overturned, arguing that a former president has immunity from criminal prosecution.
