The Government has issued a decision approving the investment policy for construction and business of infrastructure of Tran Yen Industrial Park, Yen Bai province.
Deputy Prime Minister Tran Hong Ha has just signed Decision No. 1438/QD-TTg dated November 20, 2024 on the investment policy for the project to invest in construction and business of infrastructure of Tran Yen Industrial Park (phase I), Yen Bai province.
According to the Decision, the Deputy Prime Minister approved the investment policy and approved the Project investor as Viglacera Corporation - JSC.
The project is implemented in Bao Hung and Minh Quan communes, Tran Yen district, Yen Bai province with a scale of 54.59 hectares. The total investment capital of the project is 2,184.33 billion VND.

In the Decision, the Deputy Prime Minister requested the Ministry of Planning and Investment to be responsible for the contents assigned to appraise the project investment policy and to perform state management of industrial zones in accordance with the provisions of the Investment Law and relevant laws. Relevant ministries and branches are responsible for the contents of appraisal of project investment policies within their functions and tasks in accordance with the provisions of the Investment Law and relevant laws.
The Ministry of Agriculture and Rural Development is fully responsible for the content of the appraisal, the completeness, accuracy and validity of the dossiers, documents, data and contents submitted to the Prime Minister for consideration and decision on the policy of converting forest use purposes to other purposes to implement the project; presides over and coordinates with the Ministry of Natural Resources and Environment and relevant agencies to be responsible for directing and guiding the People's Committee of Yen Bai province to closely inspect and supervise the conversion of forest use purposes to other purposes to implement the project in accordance with Directive No. 13-CT/TW dated January 12, 2017 of the Secretariat on strengthening the Party's leadership in forest management, protection and development and regulations of forestry law.
In addition, the Ministry of Natural Resources and Environment coordinates with the Ministry of Agriculture and Rural Development to direct and guide the People's Committee of Yen Bai province to closely inspect and supervise the conversion of forest use to other purposes to implement the project in accordance with Directive No. 13-CT/TW and is responsible for appraising the environmental impact assessment report of the project in accordance with the provisions of the law on environment, in which attention is paid to the discharge of waste from Tran Yen industrial park into the upper reaches of the Red River; closely monitor, inspect and supervise the environmental protection work of the investor during the project implementation process, ensuring no impact on water resources in the downstream area of the Red River.
The Ministry of Construction is responsible for the use and mobilization of capital by Viglacera Corporation - JSC to invest in the project; ensuring investment efficiency, preserving and developing state capital during the project investment process and supervising, checking and inspecting investment activities, managing and using state capital at enterprises in accordance with the provisions of the Law on Management and Use of State Capital Invested in Production and Business at Enterprises.
The People's Committee of Yen Bai province is responsible for the contents previously approved, appraised, approved or resolved related to the withdrawal of the investment policy decision of Edge Glass Joint Stock Company, ensuring that no complaints or lawsuits occur. The implementation of phase II of Tran Yen Industrial Park (84.41 ha) must comply with the conditions for attracting investment and effective land use; in case of adjusting this area and changing the purpose of use to another purpose (if any), it must comply with the provisions of the law on planning, industrial parks, land and related laws.
Organize the preparation and implementation of plans for land recovery, compensation, support, resettlement, change of land use purpose, and land lease to implement projects in accordance with documents approved by competent authorities on the scale, area, location, and progress of project implementation, comply with the provisions of the law on land and other relevant legal provisions; ensure the legitimate rights and consensus of organizations, individuals, and subjects whose land is recovered, avoid complaints and lawsuits that affect local security and order...
Viglacera Corporation - JSC (investor) is responsible before the law for the legality, accuracy and honesty of the contents of the project dossier and documents sent to competent state agencies; invest in the construction of the infrastructure system according to the construction planning of Tran Yen Industrial Park (Phase I) approved by competent authorities; bear all risks and costs and take full responsibility according to the provisions of Article 47 and Article 48 of the Investment Law in case of violation of the provisions of the law on investment and the provisions of the law on land; receive opinions from ministries, branches and the People's Committee of Yen Bai province.
Ensure the use of equity capital as committed to implement the project on schedule; fully meet the conditions for real estate business enterprises according to the provisions of the law on real estate business and the conditions according to the provisions of the law on land when carrying out industrial park infrastructure business activities; specify the loan plan in the credit contract; deposit or have a bank guarantee on the deposit obligation to ensure project implementation.
