The Standing Committee of the National Assembly believes that this is a major policy, applicable to public and non-public teachers, requiring large resources from the state budget.


Continuing the 42nd Session, on the morning of February 7, the National Assembly Standing Committee gave opinions on explaining, accepting, and revising the draft Law on Teachers.

Specific regulations on conditions for teachers to have their retirement age extended

Chairman of the National Assembly's Committee on Culture and Education Nguyen Dac Vinh said that the draft Law on Teachers after being accepted and revised includes 9 chapters and 46 articles; 4 articles less than the draft submitted at the 8th Session.

Regarding funding sources and responsibility for paying for training and development costs for teachers, especially for non-public teachers, it is proposed that the Government specify in detail the training and development of teachers and the funding for performing this task.

The drafting agency proposes to accept and supplement the regulation "Funding for compulsory training and development is guaranteed by the state budget;" this policy applies to both public and non-public teachers.

The Standing Committee believes that this is a major policy, applicable to public and non-public teachers, requiring large resources from the state budget.

The new impact assessment report only assesses the cost of mandatory training and development for non-public preschool and primary school teachers.

This policy is not consistent with the provisions of the Law on Civil Servants. Therefore, if the provisions are as proposed by the drafting agency, the State budget cannot cover all costs of training and fostering public and non-public teachers at all levels and training levels.

The National Assembly Chairman hopes that every teacher will always be a shining example of ethics and cultural behavior; strive to overcome all difficulties, be dedicated, responsible, love the profession, and care for students.

In case of maintaining the above regulation, it is necessary to assign the Government to specify in detail the funding sources for implementation, in which the State budget supports non-public teachers.

The draft Law is expected to be designed into two options. The first option stipulates that the funding for compulsory training and development is guaranteed by the state budget and assigned to the Government for detailed regulations.

Option two, regulations for teachers in public educational institutions are implemented according to the provisions of the Law on Civil Servants; for teachers in non-public educational institutions, the State budget will support the costs of compulsory training and development, and the Government will provide detailed regulations.

In addition, the draft Law is revised in the direction of removing the specific regulation on increasing 1 salary level in the administrative career salary scale system for teachers recruited and receiving salary for the first time.

Teachers' salaries are ranked highest in the administrative career salary scale system. Improving salary policies for civil servants and public employees needs to be studied and calculated synchronously in the process of building salary policies according to job positions.

Notably, there are suggestions to specify requirements and conditions for teachers to extend their retirement age; concerns about extending working hours for teachers at preschool and general education levels...

The Standing Committee of the Committee believes that it is necessary and reasonable to stipulate that teachers with high qualifications, academic titles, and degrees, and teachers working in specific specialized fields and sectors can have their working time extended and retire at an older age in order to take advantage of and exploit high-quality human resources; to overcome the shortage of highly qualified teachers in a number of specific specialized fields and sectors that the country's development trend requires.

The draft Law also clearly stipulates the conditions for implementing this policy when educational institutions have a need, teachers are healthy enough and voluntarily extend their working hours; at the same time, it adds the criterion of "meeting the standards and conditions of the educational institution."

During the period of extended retirement age, teachers in public educational institutions shall not hold leadership or management positions and shall not retain leadership or management position allowances.

Clarifying regulations on authority to recruit teachers

Commenting on the salary and benefits policy for teachers, Vice Chairwoman of the National Assembly Nguyen Thi Thanh said that in the coming time, we will continue to implement salary reform according to job positions.

The draft law stipulates that "when teachers are first recruited, the starting salary will increase by 1 level compared to the general salary scale system," which may create inconsistency and inadequacy when studying the overall salary reform system according to job position.

Vice Chairwoman of the National Assembly Nguyen Thi Thanh suggested that when implementing specific job positions, the salary scale system for teachers will be designed in the direction that teachers' salaries are ranked highest in the salary scale system.

"This content has been shown and affirmed in Article 25 of the draft Law," the Vice Chairman of the National Assembly stated.

Regarding teachers' ethics, Vice Chairman of the National Assembly Nguyen Khac Dinh said that it should be changed to "regulations on teachers' ethics" because teachers' ethics are difficult to define, expressed in teachers' daily behavior and conduct, and evaluated by everyone.

Sharing the same view, Vice Chairman of the National Assembly Tran Quang Phuong said that ethics is a system of standard values.

However, in dictionaries, it refers to the code of conduct or the system of principles and norms to regulate behavior. Therefore, the Vice Chairman of the National Assembly agreed with the proposal to change it to "regulations on teachers' ethics," which is more convincing and avoids unnecessary academic debate.

Regarding the regulations on the authority to recruit teachers, Chairman of the National Assembly's Law Committee Hoang Thanh Tung requested clarification of the differences between the draft Law and the Law on Civil Servants.

In addition to decentralization to heads of educational institutions, the draft Law is stipulating decentralization to educational management agencies. However, the Law on Civil Servants only decentralizes to heads of public service institutions.

"Thus, we are opening up but restricting the rights of educational institutions - as public educational institutions. This issue needs to be clarified as to whether it is more favorable or more restrictive for educational institutions, compared to the provisions of the Law on Civil Servants," said Mr. Hoang Thanh Tung.

Regarding this issue, Chairman of the Ethnic Council Y Thanh Ha Nie Kdam proposed clarifying the management of teachers for public educational institutions that are given the right to autonomous recruitment, which agency will be in charge of the transfer and rotation of teachers' work?

Chairman of the Ethnic Council Y Thanh Ha Nie Kdam also requested the Drafting Agency to consider, research and supplement policies to attract teachers of ethnic languages ​​in ethnic minority and mountainous areas; specific policies in recruiting ethnic minority teachers and teachers with high professional qualifications to work in ethnic minority areas.../.
