Standing member of the Secretariat Luong Cuong has just signed and issued Regulation 148 of the Politburo on the authority of leaders in temporarily suspending subordinate officials from work when necessary or when there are signs of serious violations of Party regulations and State laws.

It is strictly forbidden to take advantage of temporary suspension from work for personal purposes.

This regulation applies to heads of Party committees, Party organizations, agencies, units; cadres, civil servants, and public employees in the political system and public service units.

The temporary suspension of officials under the management of the Politburo and Secretariat shall be considered and decided by the Politburo and Secretariat.

For positions of Party Committee members, National Assembly Deputies, People's Council Deputies, judicial positions, members of the Vietnam Fatherland Front Committee and members of the executive committees of socio-political organizations, temporary suspension shall be implemented in accordance with Party regulations, State laws and organization charters.

The head of the unit who temporarily suspends a subordinate must ensure timely prevention of negative impacts that hinder the consideration and handling of violations against the employee; it is strictly forbidden to take advantage of temporary suspension for personal purposes.

When a leader has announced retirement, announced leave of absence pending retirement, or is being transferred to another job, or is being considered for disciplinary action, inspection, or examination when there are signs of violations or complaints, he/she must report to and receive approval from the standing committee of the immediate superior Party Committee before exercising the authority to temporarily suspend work.

5 grounds for temporary suspension from work

Firstly, officials who violate ethical qualities and lifestyles cause negative impacts, public outrage, and adversely affect the reputation of organizations and individuals.

Second, officials deliberately delay, shirk responsibility, and do not perform work within their authority according to assigned functions and tasks.

Third, officials have corrupt and negative behaviors, causing trouble for people, businesses, agencies and organizations in the process of performing public duties.

Fourth, an officer who is being considered for disciplinary action intentionally delays or avoids complying with the request of a competent authority during the process of considering and handling his/her own violations or takes advantage of his/her position, authority, or influence or that of others to influence or cause difficulties in the consideration and handling.

Fifth, cadres who have been disciplined by the Party in the form of warning or dismissal and are awaiting consideration and handling of their government positions, and if they continue to work, it will negatively affect the activities of the Party Committee, Party organization, agency, or unit.

The period of temporary suspension from work, if necessary, shall not exceed 15 working days. If an extension is required, the maximum period of temporary suspension from work shall not exceed 15 working days.

The Politburo also clearly stated the grounds for temporary suspension from work in cases of serious violations.

These are cadres who are prosecuted to serve the investigation; during the process of reviewing and handling the cadre's violations, there is a basis to determine that disciplinary action from warning or higher must be taken or handled by criminal law, and the inspection, examination, audit, investigation, prosecution, trial, and execution agency has a written request to temporarily suspend the cadre from work.

In this case, the suspension period is implemented upon request of the agency conducting the proceedings; inspection; examination; audit; or execution of the judgment.

The head is responsible for promptly deciding to temporarily suspend a subordinate officer from work when there is one of the above grounds; promptly canceling the decision to temporarily suspend a subordinate officer from work in case of non-compliance with regulations or when there is a conclusion that there is no violation, and at the same time reporting to the competent authority in charge of managing the officer.

This decision must be announced in the agency or unit where the officer works and sent to relevant agencies, units and individuals.

In addition to the responsibility to comply with the decision, the suspended officer has the right to request the head to reconsider the decision if there is reason to believe that the suspension is not in accordance with regulations.

In addition, they will also have their legitimate rights and interests restored when the competent authority concludes that they have not violated or been disciplined for violations.

The regime and policies for cadres during the period of temporary suspension from work shall be implemented as before the time of temporary suspension from work.

The Prime Minister decided to temporarily suspend the work of the Deputy Minister and Chairman of the Provincial People's Committee.

The Politburo also issued an appendix to Regulation No. 148, clearly stating the authority to temporarily suspend work in Party agencies and State agencies.

In which, the heads of the Party's departments and agencies at the Central level decide to temporarily suspend work with: their deputies; heads of affiliated agencies and units.

The National Assembly Chairman decided to temporarily suspend the work of: Vice Chairman of the Ethnic Council, Vice Chairmen of the National Assembly Committees; Deputy Head of the Delegation Affairs Committee, Deputy Head of the People's Aspirations Committee; Director of the Institute for Legislative Studies; Chairmen of provincial People's Councils.

The Prime Minister decided to temporarily suspend the work of: Deputy Ministers and equivalent; Chairmen of Provincial People's Committees; and people holding positions appointed by the Prime Minister.

Ministers, Heads of ministerial-level agencies and Government agencies decide to temporarily suspend work of: Heads of agencies and units under ministries, ministerial-level agencies and Government agencies.

The Chief Justice of the Supreme People's Court (SPC) decided to temporarily suspend the work of: Deputy Chief Justice of the Supreme People's Court; heads of agencies and units under the Supreme People's Court; Chief Justice of the High-level People's Court; Chief Justice of the Provincial, District and equivalent People's Courts.

The Chief Justice of the Supreme People's Procuracy decides to temporarily suspend from work: Deputy Chief Justice of the Supreme People's Procuracy; heads of agencies and units under the Supreme People's Procuracy; Chief Justice of the High-level People's Procuracy; Chief Justice of the Provincial, District and equivalent People's Procuracies.
